A question about : Wills
Mother past away and left estate to 4 kids. 1 child past away 31 days after wot would happen to her share of the will. Thanks any advice would be great.
Best answers:
- Depends on the terms of the will , if a child passed away within 30 days they can be excluded from the will and their share dispersed amongst the rest
Executor will tell you - There could be no survivorship clause in the will. It might say any period although 28/30 days is quite common.
If the deceased child has lived for the survivorship period then the bequest will be dealt with by the executor/administrator of the child's estate. If they have not, then that bequest will fail but exactly what happens depends on the wording of the will.
