A question about : Take over of a business/comany

Hello all, just one or two questions someone may be able to answer, for me.
How do takeovers from one business to another work,do all rights stay in place ?
As i have been on long term sick for a while, but a long term employee, over 10 years,i have heard of a take over whilst on leave.
I have had no contact with my employer, last December 2013,one human resources, who was dealing with me has now a dead phone number and i have also contacted by mail, letters and sick notes regular, but as to yet no correspondence.

Would i know if i was terminated on ill health, would i received a letter stating this ?if a new employer did not want me on there books ?

Thank you,

  • Wow.
Google "TUPE" and read up on your rights of employment. Then you MUST contact the company and find out who owns it.
Are you getting Sick pay at all?
Do you have a Return To Work date planned?
    Any Sickness Reviews planned?
Who is your Line Manager that signed you off sick?
  • Depends on the type of takeover on what happens. TUPE does not apply in all cases.
you will need to research what has gone on.
  • My line manager has changed three times since been off work,I was in contact with the manger I knew, then everything went through a second hr.
I do not get paid sick pay and was pushed on to esa,the last I heard was as stated December, when I was given a ultimatum to return in January of this year (which was not ready) and if not they was going down the disciplinary route on ill Heath grounds.
So heard through the grape vine and checked online and see it in black and white it had been bought,oh and the human resources direct conatct number no longer exists.
  • Previous to last hr signed me off sick,
  • What's changed since the last time you posted ?

  • I'm sorry to offend you 'pooh sticks' for posting in another group,
  • It would help (and be polite) if you answered the questions in the other thread.
  • Yes,sure there both Ltd companies,
  • Tomtontom I will say sorry to you also,if you are a admin on this site please feel free to delete one if the posts.
  • All I know is company A who I am employed with has not changed name yet,but it's head office is the same as company B whom has purchased, taken over.
All company directors I knew have all stood down and now doing other roles in the company.
Information off 'company check/people that currently work there.
On the buyers web site it says acquisition of company 'A'
  • Is company A still an active company?
This can be seen from the Companycheck, and whether it has filed accounts, is an administration/liquidation, or is dissolved.
    CK
  • Yes company A is still active,on the company check it has info on director resigned from there roles including the owner and new ones been appointed (from company B).
The only things that have changed is
    -the directors/owner of company A
-the head office address (now company B's)
-no official name changed to business yet
There all stated on the company check web page
Company B site it states acquisition of company A depots,
As far as my employer know I have no knowledge of a take over it was only by chance I found out,I had been sending in sick notes and letters (by recorded) but was not getting any feedback, also the phone numbers to my human recourses didn't help,as they no longer exist.
So I don't want to jump the gun start ringing up,which was my last head office asking what's going on,as they might be sorting things out,I don't know what to do,
  • What would be your ideal outcome?
  • I was satisfied with there last suggestion, which would have been to dismiss in health grounds, but if a new company has taken over, probably be a different story now,I don't wish for old or new to keep me on there books,as I'm coming over a time waster, well that's what I think anyway.
Like I said I've never been dismissed, warning yes but never been given my cards, paid notice or holiday pay owed.
  • So you basically want to resign..? Or have I misunderstood?
