A question about : Reclaiming bank charges query: Abbey

I am currently in the process of reclaiming my bank charges from Abbey. I sent off my Ј10 and requested 6 years worth of bank statements within 40 days (as per the DPA). I waited 2 months..... I rang them a couple of times, the last is when I finally lost my patience. I told them that they were breaching the T&Cs of the DPA and I would be reporting them... lo and behold the statements turned up 3 days later!

So, I've done my spreadsheet, printed off the letter and sent it all to them requesting that my charges be refunded by 2 October 2006. I have since received a 'holding' letter from them stating that they are looking in to my complaint but want to do a thorough investigation and sometimes this can take time. If we have not contacted you before then, we'll write to you in four weeks to let you know what is happening....

Has anyone else had similar? Can they do this, or should they abide by the 14 day deadline?

  • When I did this for my friend, we got exactly the same answer. She decided to let them have their time and they did reply within the indicated period with an offer of a refund. I guess it is up to you whether you give them a chance to check the figures or issue proceedings after the fourteen days. If it was me I would wait the four weeks and see what they come up with.
