A question about : parking ticket in hospital

Hi,
I work in a hospital where, believe it or not, the stress of parking is as bad for us as staff as it is for patients and visitors. I am a clinical nurse specialist and have to use my car not only to travel the 25miles to and from work but also throughout my work day; for home and school visits, to attend clinics on other sites as well as child protection meetings. I have in the last 4 months received 2 parking fines. The staff parking is inadequate and there are more than often not enough space to park in a marked bay which is essentially the claim of the PCN.
I appealed the first through the conventional means only to receive the response that thust is upholding the fine. The second fine was gleaned between the inital and outcome of the appeal.

I have read the newbies thread, but as far as I can establish, the hospital employs a solicitors firm to chase the fines, the windscreen ticket has the hospital notehead, neither seem to be registed with either the IPC or BPA.

How do I go about fighting this one?? I have engaged my local union rep who suggests that ordinarily they don't intervene but they are looking into it as it appears that it might be the trust that has the ownership. My job description states that I must be a car user/driver to be able to do the job.

  • What you need (and others) is a clear statement by management on the procedures to follow if there are no spaces available. As you have to leave and return during the work day, then it is entirely possible that a space will not be available on your return.
    What should you do?
    Management needs to be put on the spot and give you clear procedural guidelines. It's simply not good enough to run the car park as a money making scheme to penalise their own staff.
    Start by emailing your manager to get it all in writing.

    As part of my job I am required to own a car and leave and return to the hospital on a regular basis. Occasionally on return there are no parking spaces avalaible. Please state the procedures I must follow in such instances.
    For instance, should I wait in the car until a space is available; should I leave the site and return at regular intervals to check. Should I contact you or anybody else by phone to warn them of the situation and reschedule appointments.
    I would be grateful for a reply as soon as possible.
    get as many people as possible who are in the same situation to email their managers. It is their problem to solve, and once you know what management want you to do to solve the problem, you can follow their instructions.
  • The management are very unsympathetic and couldn't offer me an answer after the first ticket even though I predicted the second one, (just didn't anticipate it would actually be me that got it!)

  • Sounds similar to my case, I'm about to write to the local press because the trust just ignores all contact in the hope people will pay up. The above statement that it is unacceptable to run car parks to make money penalising staff, hits the nail on the head. Don't give up on this.
  • No its not one of those hospitals Ralphy and the solicitors is in Southampton!
  • The reason I ask is that some hospitals do run their own car parks, and this can make a difference as to how to proceed

  • I think that is the case Ralphy.. any tips?? I have written a letter to the trust outlining why I think the 'notices' should be cancelled and also asking for clarification about what to do next time? i'm just pondering who to send it to! I am also writing to the solicitors telling them that for the first one I am engaging the trust and for the second one that 'the driver' is directly engaging with the trust.
  • Request a copy of the contract under Freedom of Information, plus anything else you deem relevant. Is it an NHS contract if not why not. Who authorised the use of a non NHS contract.
    If it is an NHS contract there will be a very high probability that the company will not be complying with all of the T &C's of the contract.
    If you post the name of the company that sent you the begging letter, it would very easy to see if they are meeting the T&C's of national NHS contract
    The Trust's Policy, for car parking, when it was approved etc.

  • Are you a union member, and if so have you asked them to take this up?
    If it were me I would refuse to use my own car for hospital business until this was sorted. If they want you to do your job and use your own car in the process they must provide you with the necessary facilities, including parking when you need it.
  • Oxford University Hospitals NHS Trust don't appear to be member of either the BPA or IPC, so how did they get the registered keepers details?
  • I am not sure .... but if the trust owns the land and is the PPC then they can request from the DVLA

  • Just checked, assuming Trethowans have signed a standard NHS Contract, they are in breach of the T&C's
    But personally I would rip the Trust apart for not using any form of due diligence when employing the firm

    Definitely an FoI request if not by OP then someone they might know!
