A question about : Holiday Entitlement

Hi

I have recently dropped from working 5 days a week to 4 days per week and am curious about my holiday entitlement.

I was allowed 30 days and bank holidays as extra days so am now entitled to 24 - quite logical! However, I'm not sure what I am entitled to regarding bank holidays. I no longer work on a Monday so should I be getting extra holidays pro rata to allow for the bank holidays that fall on a Monday?

I want to be informed before I go to work and ask about it!

thanks for any advice!

  • Eh?
If you don't work B/H Mondays then you can get any holiday entitlement for them can you?
  • They could argue that it depends on your contract and as you are still getting more than the legal minimum (4/5ths of 28 would be 22 inclusive of bank holidays is the minimum for 4 days - you are getting 24 plus Good Friday plus occasional Christmas, Boxing Day and New Year) then you go by your contract which gives you bank holidays that you work off.
However that tends to discriminate against part time worker which is illegal. If you used to get 30 days plus the 8 bank holidays, you should now get 4/5ths of 38 days inclusive. So you get 30.4 days, one of which will be Good Friday and in a "bad" year you will also need to deduct 3 for Christmas, Boxing Day and New Year thereby leaving you 26.4 minimum free to take on non bank holidays - in a good year you might get another 2!.
  • Yep, I agree 100% with WestonDave!
