A question about : moon beever help

hi had a court summons back in January 2013 for a Halifax credit card Ј2,385.52 my defense was i asked for the cca request in 2009 and was still waiting ..then received a letter which i could not see my signature rang them up they gave me a big lecture on we have your payments etc i asked them for a expenditure form which i filled in as i could only afford Ј15 a month they rang me back saying Halifax would not except this only Ј20 and to increase it so many months later sent me a tom lins or something order which i would not sign... they know want me to appear in my local county court on the 25th October 10am send me this big case thing which the last payment was 29/07/2008 could i defend saying its statue barred or am i to late...also i moved from my old address in feb 2012 as i separated from my husband told the county court back in 2013 only cause my kids sometimes give me some mail or i would of even received the court summons they still have sent this big case file to my old address could i also defend my self as i never received half my letters ...any help would be appreciated x x x

  • They started court action less than 6 years after the last payment so cant be statute barred. Sorry.
  • A Tomlin Order stays proceedings providing you keep to the terms agreed in the Schedule.
    It might have been in your interests to agree it as it avoids you getting a CCJ
