  • I'm in the same position: Monarch has had my claim forms since the beginning of November, but I've had nowt but a terse acknowledgement.
    Perhaps the fact that no one (or almost no one) has had a substantive reply yet means Monarch are deliberating about whether to pay up, and they're just need a little more encouragement to take the plunge? Or is it that they are a bunch of shysters, trying to evade their legal responsibilities and treating their customers with contempt. Answers on a postcard ...

  • I too have submitted a claim to Monarch, which included all the information they could reasonably require. I experienced the standard stalling tactic of asking me to resubmit on their forms separately. No doubt some folk give up at this point.
    I sent them their forms back with every thing they wanted on the 10th November 2012, and have heard NOTHING from them since. I sent them a chase up email on the 3rd Jan, and again they have not replied.
    This gets me thinking that:
    1) They are overwhelmed and totally incompetent at handling the claims and I will get there eventually; or
    2) They are stalling deliberately, to deter as many people as possible fromc laiming. Maybe they will force everyone to go to court on the basis that only10% may be determined to take things that far? This would be commercial suicide as their reputation is going down the pan. I will certainly never book with them again and I'm telling all my friends and colleagues to avoid them too; or
    3) They know they are going to go bust and are just stringing this out for as long as possible.
    Their approach is quite strange, and does not make good business sense to me.
    Is there no one who is an insider working within Monarch who can tell us what is going on and what tactics they are employing?

    There are guidance notes with it with some odd comments such as "for legal reasons" they are only accepting claims up to 2 years from date of arrival of the delayed flight. I've just queried this on the Monarch Facebook page and they say they'll get back to me as the claims team has gone home. The notes also give the CAA guidance about extraordinary circs which must be taken with pinch of salt.

  • Well looks that I am slightly more advanced than most. 26 hour delay from Palma in July 2012. Monarch claim extraordinary circumstances ~ basically one problem bought on another ~ breakdown took longer to fix than they expected so by then crew out of time. Issued MCOL in November and spoke to Court yesterday - informed will be in March but awaiting, as I understand it, Monarch to agree actual date.
    Monarch seem to reject all claims and decide to defend. Whether they do defend in Court or not I wait to see however this route must cost them (and their shareholders) less as the 'tactics' they employ put a lot, if not the majority, off claiming as does their wrong interpretation of extraordinary circumstances as outlined on THEIR claim form. With regard to this aspect alone I suggest claimants use the standard EU regulated claim form.
    Thus Monarch are likely to save themselves a significant amount of money but alienate a few disgruntled delayed passengers. As many of these passengers, sometimes, have little choice in carrier the amount of traffic they are likely to lose is insignificant.
    I therefore believe it is incumbent for the CAA and Courts to make sure Monarch do not use these underhand tactics to avoid paying legitimate claimants.
  • WPC: That's really interesting to know. Can you give a bit more background on your correspondence with Monarch? Did you fill in their compensation form, for example, and if so when was it sent? Did Monarch offer you a reply before you went to MCOL? Or did you go straight to Court?
  • Wrote to Monarch 3 times - 1st when delayed = wait for Sturgeeon, 2nd = now Sturgeon so give me compensation no reply 3rd when Monarch decided they needed THEIR form completed = again no reply so after 3 attempts gave up and decided they were playing a game/idiots so NBA with 14 day response. No response so MCOL. Again they left for 14 days (maximum permitted) before replying to Court via an acknowledgement which gave them another 14 days. Again on 14th day they defended giving me a 14 day response time but all over Christmas and New Year period so post times etc intervened. I have complied with court dates etc throughout (as they have done) however I have responded WITHIN the 14 days whereas they have replied on the 14th day. If you look at the Sturgeon challenge you will see the airlines who challenged the ruling in the first place ie not Monarch ~ likewise my MCOL application is not being defended by Monarch (well it is in name only) but by Tui. Basically they are playing a game but with 220 courts in the UK they have plenty of time and judges to string along (and possibly some cases they will not lose) before the Courts and the CAA 'have a word with them'.
  • This is my experience of Monarch to date after delay of >5 hours MAN to PMI in 2011 (this is apart from to-ing and fro-ing on Facebook):
    Monarch sent out email within days of the delay (and without prompting) in which they apologized, explained there had been a technical fault and suggesting we contact our insurers.
    I wrote to claim compensation.
    No response so sent a reminder some months later.
    Without further delay Monarch wrote back to explain about the stay and invited me to write again when the appeal had been determined.
    I left it a while as I knew they'd be inundated and eventually sent my second claim letter on 02.01.2013 along with all the docs which I thought they might need. Unsurprisingly not heard from them yet but hadn't expected to as it's early.
    I just wanted to tell this so people know that at least Monarch has been in touch now twice. I'm not holding out much hope for a settlement without a fight but have to give some credit where it's due.
  • Apologies Vauban but I do not think it is curious. Monarch have decided IMO to disregard the ECJ ruling and hide behind the extraordinary circumstances wording therefore putting people off claiming by putting doubt in their minds. A Court application costs around Ј30 and realistically at most you may lose Ј50 if the other side claim costs. A Tui lawyer probably charges Ј200 > Ј300 an hour - a case, with travel time, will last a day. With around 220 Courts and 220 working days in the year at best 200 Monarch claims (never mind TC, First Choice etc) will take a year to be heard. Just work out the logistics cost/timing etc and Monarch are on a total winner if they do not pay out/do not respond and delay.
