A question about : Monarch claims cut off date

Hi Everyone

Just been going through my paperwork and found my claim form for the Ash disruption. I emailed their claims e-mail address and recieved the following.

Dear Mr ********

Yes the address is correct. However, please note we are not accepting new claims after 1st October unless there is valid reason for a delay in submitting the claim

Yours sincerely

Hi

Is the address below correct for sending my ash claim to?

Just been going through my paperwork and realised I hadn't sent it off yet.

Regards

Has anyone else heard of this and are they within their rights to set a cut off date?

Any advice would be much appreciated

Regards

  • Well they can say that if they like I suppose, it's no worse than other things they have been saying! But AFAIK there's nothing at all to back it up, it's yet another tactic they are using to deflect as many 'claims' as possible.
Ooooh I hate that word 'claims' that most Airlines are using - as if it's some sort of insurance claim when in fact it was our legal right to be paid for at the time and they denied it!
Never mind a 'claim', you have six years to sue them if they didn't provide your Right to Care under EC261/2004. That's the stage several of us on this forum are at with Monarch because even if you'd sent off their 'claim' form earlier you would find they would have offered a ridiculously low, arbitrarily capped amount, regardless of receipts. We were 'offered' Ј20 pp per day for food/refreshments and accommodation which is ridiculous so we are taking it further.
Have a look at the t&cs on your house/contents insurance policy, your Bank Accounts & credit cards etc first of all to see if you have 'legal cover' which might pay the cost of legal advice and representation in Small Claims Court. That would make it easier for you as letters & negotiations, and ultimately the Court process could be handled by a Solicitor at no cost to you (Solicitors' costs cannot be reclaimed in the Small Claims track, so only use a Solicitor if you have legal cover IMHO).
If not then do it yourself and fire off a claim on MoneyClaimOnline and hope that prompts them to settle. How much are you claiming and what were the circumstances?
