A question about : holiday entitlement

please can anyone help.

I have to rely on a lift to work,so I work these hours- im partime working 64 hours plus 9.5 overtime each month.

see below hours/ days I work.

wk 1 mon/thur = 2 days 12.75hrs

wk 2 mon /thur=2 days 12.75hrs

wk 3 mon/thur = 2 days 12.75hrs
( work 3 x weeks total worked =38.25hrs)

wk 4 mon/thur = 2 days 12.75hrs
sat/sun=2 days 22.5 hrs
(work 1x week total worked= 35.25 hrs)

these are my hours/days I work every month are my correct in saying im entitled to 89hrs-36 mins holidays

  • It all depends on what the full time staff get as holiday entitlement, yours will be that pro rata.
  • But you don't get holiday accrual on overtime. Only on the basic hours.
  • The irregular hours calculator on gov.uk confirms that the statutory leave for someone working 16 hours per week is 89 hours 36 minutes.

  • Basically, holiday entitlement at the statutory minimum (28 days including Bank Hols) is 12.07% of the hours you have worked - not incuding o/t hours.
    (31 days including bh's for agricultural workers = 13.54%)
  • Just the average of the prior 12 weeks. The amount of work done then the amount of a week’s pay is the pay for the normal weekly working hours multiplied by the workers average hourly rate over the preceding 12 weeks. This may occur under a piece work, bonus or commission system. To calculate the average hourly rate, only hours where the worker was working, and the pay related to them, should be taken into account. Overtime hours can be included although pay for these hours should be adjusted to the normal rate. Any week in which no pay was due, for hours worked, should be replaced by the last previous week in which pay was received for hours worked. (sic ACAS)
