A question about : Help Regal Credit Consultants LTD legal notice.

Hello guys, yesterday Regal Credit Consultants LTD has sent a letter taking legal action against my father debt, which they are granting a County Court Judgment on my father, if successful there would be actions taking taking against my father such as Bailiff to levy goods, employee deductions or charging order placed on property.

All this worries me and my family especially my father, so far I have been vague so I will now explain everything before this letter.

My father had an accident 3 years ago, where my father brush past some guys left hand mirror, even though there was no damage to mirror whatsoever the guy decided to claim my father. This lead to the guy car being repaired and car hire service with the total cost of Ј3275.89 in which my father has to pay. Albany Assistance Limited handled everything.

The problem is the amount of debt my father owes Ј3275.89 for just brushing past the guys car is ridiculous, when I asked Albany Assistance Limited for costs breakdown it shows the hire costs was Ј2620.80, repair was Ј595.09, engineer Ј60 and recovery Ј0.

When I further investigated into the costs, I found out the ridiculous hire charges was was Ј177 per day + Ј60 delivery and collection. The hire lasted 12 days which gave the costs of Ј2620.80. Next I looked at repair and found out they painted parts that my father didn't even touch and the repair period was only 1 day. Which leaves me to this question why is there a 12 day hire cost for a 1 day repair this seems to me like a scheme to make money.

This debt was handed to Regal Credit Consultants, they have sent letters demanding immediate payments of the debt however my father has refused to do so as he believes such little accident cannot cost so much money and now they are going to take legal action, my father doesn't have much money and often borrow money from me (i'm a student)

Now I fear the worst in the upcoming days, can anyone provide to me any help or tips in dealing with my situation. I'm sorry for the long post but its hard to make a short post about my father situation.

  • Sorry if this sounds stupid but was your father in a car when he damaged the car mirror? Did he report the incident to his insurer at the time?
    Has there already been a court claim and a ccj already granted against your father? Or has he only had threatening letters from this debt collector?
  • Why doesn't his insurance cover the cost of the accident?
  • Sounds to me like a complete con. Why did your farther not let his insurance company handle the matter ?
    seems as though he has opened a can of worms for himself here.

  • @thewhiteavenger, My father wasn't in the car when this accident occurred, he was outside the parking area when this happened. At the time he did report the incident.
    @Asiacat, They should of dealt with this, but I don't know why they haven't maybe I need to further investigate my fathers insurance company at the time.
    @sourcrates, My father doesn't speak English that is why I have been speaking to him on his behalf, from the other replies it seems like the insurance company should of dealt with this situation. My father said he did report this accident to his insurance company at the time, My father did change insurance last year maybe that had part to do with it? I only found about this accident 2 months ago my father never told me anything for some reason, So i'm not entirely sure what happened.
  • Refer everything to the insurer that he reported to at the time.
  • He wont be liable pass all to insurance, they will also dispute the hire charge
  • Do you mean your father was accused of damaging the wing mirror as he walked past a vehicle rather than damaging it with his own car?
    If so I'm not sure that his car insurance will cover him for this.
  • My father told me he was in a parking lot and walked past the guys car and accidentally touched it with his elbow, the guy so happened to seen this outside his shop so that's how he found out.
    My father doesn't have household insurance.
  • Who has signed the letter ?
    Is it signed by a solicitor.
    If not, it's a bluff and if they have not sent stamped court papers then they are trying it on.
    Inform them the debt is denied and the matter will be referred to the police vulnerable persons unit as it appears someone is trying to defraud a elderly vulnerable person and they are assisting them.
