A question about : Help with Defaults and ccj's

I have 8 accounts with Lowells, all are in default by OC, they closed 3 accounts down when I sent them prove it letters, they are getting a CCJ on another account and I'm making Ј1 payments on the others. What I want to know is all the open accounts are at some point this year about to drop off my credit report as they are 6 years defaulted. Can the DCA get ccj's against me after they have dropped off if I stop paying them. Do the debts need to be in default for them to apply for a CCJ ? Can an account only be defaulted once ? Sorry for all the questions but thanks for any help.

Best answers:

  • Accounts can only be defaulted once.
They can get a CCJ, even when the account has dropped off your report.
The fact they own the accounts means they are defaulted? Or are they collecting for the original creditor? But yes, I think they need to be defaulted to go for a CCJ.
Ate any of these accounts taken out before April 2007?
  • Yes a lot are pre 2007.
  • For pre 2007 ones, send. CCA request. Google it.
If they don't have the original, they are rather stuffed
  • Good point. For cards, loans, catalogues send a CCA request. Not for overdrafts.
  • They are for credit cards, and catalogues, I have gone down the CCA request route and Lowell are still taking me to Court to get a CCJ for the account they didn't supply a CCA for !
