A question about : Harassed For Mortgage Shortfall

Hi all,

This information on this site has been a godsend throughout my bankruptcy, it's a great community. I thought when I was discharged in October 2014 that would be the end of it but unfortunately not.

Following diagnosis of an illness I was forced to quit my job and reluctantly file for bankruptcy. I was made bankrupt in October 2013.

During this period of bankruptcy my appointed Trustee in Bankruptcy wrote to all my creditors requesting that any contact regarding my bankruptcy be made with him and that I should not be contacted directly. Every creditor but one complied with this request. For 6 months from October 2013 Mortgage Express continued to call me and write to me demanding payment. I sent more than 6 letters to Mortgage Express asking them to follow the correct process and that their direct contact was upsetting, harassing and unwelcome. Eventually they stopped contacting me however since the sale in November 2014 of the home that they repossessed they have started writing to me and calling me again demanding payment of the shortfall. As per advice from my trustee and the CAB I assumed that this shortfall was included in my bankruptcy as the outstanding mortgage and expected shortfall was included in all the paperwork. My trustee has also written to Mortgage Express asking them to file a claim as per the process but still they call and send letters.

Has anyone been in this situation before and can recommend an escalation point or regulatory body that I can ask to investigate?

Any help would be massively appreciated, I feel I'm at a dead end.

  • The main thing lenders fear is the time the debtor gets a control of their situation
    Don't put up with their hassle, use the link above
    Have fun with them-
    Answer the phone but don't go through DPA (data protection), they will be breaking the law if they discuss your account with you when they have not gone through DPA
    A guy I know would 'forget' his post code, date of birth etc- if you fail these questions they cant go any further
    If you do this you will be wasting their time, not yours
    You could do as I did and buy a 0700 number- costs them 50p a min to call and you can divert it to your new mobile (or anywhere you want) for free. Just go thorough DPA, give them your new number and have fun at their expense for a while
