A question about : halifax bank charges (merged)

just a quick question, has anyone claimed from the halifax, and how long is it from you returning the letter for full and final settlement to you getting your money returned into your bank account.

  • Hi, I posted my request for statements on the 8th of September and I'm still waiting for them I rang the bank on Friday to chase them he said it would take 3 to 5 so I think I'm gonna ring again now.
    I have asked a similar question on another thread and didn't get many responses. Hope your is more successful than mine.

    This is the first time I have posted a question on a forum. I have received bank charges and am at a loss as to what to do next as I just can't afford them. I have had 5 separate charges (3 in end of Oct and 2 in beg of Nov) for using my debit card, not knowing I was at my overdraft limit. Therefore, the bank have charged me on all these occasions as well as charging me a further Ј28 for going over my over draft limit (due to the charges by the bank).
    The charges are Ј30 each, making a total of Ј178 of charges from Halifax bank. I wrote them a letter saying that I believe these charges are not fair and unlawful and that believe I should have a credit for them. However, I have just had a letter back from them saying that they feel the charges are right and they can't give me a breakdown on the charges. Also they state ' hopefully we can resolve your concerns, or if we are unable to do so then we'll provide you with details of how you can contact the Financial Omburdsman Service for help.'
    I am really at a loss as to what to do next, shall I write them a further letter. I am a little scared that it will end up costing me more money to get this back which I just can't afford.
    Any help with this would be greatly appreciated and am open to any suggestions.

  • I would try ringing them, and trying to get the charges for the one for going over your od llimit becasue of their charges.
    They do see to cave easier if you talk to them in person and try not to get annoyed with them. just explain that its their charges that put you over and therefore could you have that charge recinded.
    my son recently did this with NAt West and had his recinded, and I've done it with the halfax as has my oh so it is better in the phone.
    also there a limit they can charge you in any one month, which I thought was £75 you might like to check this as it may have been altered.
    ask why they allowed the transactions to go through if you didnt have the money available and that you thought that that was the way chip and pin was supposed to work. - ie you cant go over becasue it gets refused.. its worth a try.

  • Thanks for your helpl. I did try to phone them at the beginning but to no avail, they just said it was my own fault and need to pay it. However, I will look into that maximum charge you mentioned.

    I Claimed back over £1500 in charges from the Halifax. Like you I rang and asked them for about £150 they had taken in 3 days. They almost (but not quite) told me to get stuffed.
    I followed the link on here that Martin had given to the Consumer Action Group website and have not looked back.
    I decided if I was going to do it I would go back 6 years and get those charges as well.
    Halifax give in really easily once court papers have been served, an easy one to start with. One of the more difficult ones is Barclays they fight to the death sometimes settling the day before court.
    I have had Mortgage charges back from Birmingham Midshires and will be sending them court papers for an Early Redemption Penalty shortly.
    I have also had (unjust) defaults removed from my credit file in 9 days.
    All I can say is go for it. The feeling of empowerment is wonderful. Good luck Lizzy

    I receved about £270 from Halifax I went through the procedures on the consumer action group website, starting with the prelimary letter, as long as you follow the correct procedures it is pretty easy and take about 6 weeks to do.

  • Hi everyone, I'm new on here so I will have to start from the beginning with my "debt" story
    A few months ago I split up from my partner and we both moved back in with our parents and have put our house up for sale. Since we split, we have been going thru really bad financial difficulties. To the point where we can't pay bills and creditors. Some things I have been sending payments for each month, others we cannot afford to send them anything.
    Anyway, I started to come on here a couple of months ago just having a read really about everyone elses issues and came across the "Claim back your Bank charges" thread. This got me really interested as our joint account is seriously overdrawn cos of all charges we have incurred from the Halifax. Since May 2006 we have been charged Ј1,500. God knows what we've been charged since the account was opened.
    A couple of weeks ago, I wrote a complaint letter to the Halifax about these charges, and about the fact they had transferred money from my ex's Halifax A/C into the overdrawn A/C, and transferred another amount to the credit card. They did this without our knowledge, and becuase of that, this months mortagage payment wasn't paid. So, I wrote a letter and received a reply within a couple of days. I was so angry as none of my issues had been addressed and I was sent a simple crap standard letter. So I replied telling him how i felt about his reply and I'm now just waiting for a response. I contacted the Ombudsmand first to get advice.
    I am now going to request a full list of charges that the account has incurred since being opened in 2003. I'm going to send this off tomorrow with the Ј10 fee.
    I hope I get your support on this?!! I need it!! I'm not one for writing complaint letters, and I'm a bit worried about claiming back my charges, but the Halifax have gone too far, and they know my situation, so they can't turn around and say I never contacted them

    Welcome to the board. I'm sure you'll find all the help you need here at each stage of the claiming process.
    Look out for Martins email tomorrow. It contains details of his newly written and comprehensive article on claiming back your bank charges. It will also give you all the letter templates you need to send to your bank at each stage.

    I was just wondering if anyone had the correct address and department for the Halifax PLC, as I will be sending my letter and Ј10 fee tomorrow requesting a list of all bank charges. I'm not sure which address to send the letter to. :confused:

    or you can phone 08457 20 30 40 and ask them for the customer relations address, but i think the one above is correct.

  • Hi, just to say I have claimed £1500 in charges from Halifax/Bank of Scotland, and they have not closed my account, if I was to give you any advice I would say GO FOR IT, I was mega scared to start off with but if you follow the steps you will be fine and there are loads of lovely people to ask if you are unsure about anything.

  • Quite some time ago (not got the dates to hand) I sent the standard DPA request letter to Halifax PLC requesting a breakdown of charges for the last 6 years. On about day 47 they replied saying "copies of duplicate statements have been ordered"
    This was at the start of October! On Monday I sent a further letter outlining the fact they had not complied with the DPA request and if I did not hear from them within 7 days I would be applying for a County Court Order
    Has anyone else experienced this sort of thing with Halifax ?

  • I have a loan with Halifax for around 12k would they be able to claim this back from me and has anyone had any experience of them doing this? It would really put my OH and I in amess. Im moving house in next 4 weeks so have the next 4 weeks to prepare.
  • Well that was quick! Within 45 minutes of posting that message my Halifax statements arrived by Royal mail Special Delivery
    All statements since 1990!
    Going to be a long night going through them all!
