A question about : Got a response from Lufthansa :) but not a good one :(

Hi

Got a letter from Lufthansa this morning....not going to pay compensation for the reason and I quote

we were unable to anticipate or predict what the consequences of the actions (closing of airspace) would be. Nor were we able to predict how long the situation would continue. For this reason we do not see an obligation to offer assistance in terms of the right to care as defined by EC regulation no 261/2004 article 5....The volcanic eruptions was a force majeure event and is therefore without doubt beyond our influence. We therefore see no obligation to cover the expenses incurred for accomodation food or transport

So any guidance on what I should do next? Do I have a case?

  • make sure you right to the AUC and the enforcement body in germany, EU transport Minister and keep plugging away. Court action may also help.
    This is a good article for our campaign against KLM, we are having the same problem as you. Appears to be 4 airlines holding out, KLM Air France, an Italian one KLM AF just joined forces with yours and BMI. Soon the EU has to help.

  • Just posted on the successful claims post, have heard back from Lufthansa and they are agreeing to settle our claim - they said it will take 1 working month so we're waiting for them to wire the money in - will update when its all settled!
  • Update: lufthansa have paid the money into our account
