A question about : Failure to provide CCA

I sent a cca request to MacKenzieHall at the start of July. They haven't provided the cca so I haven't been making my monthly payments.

I've had a call from them today about it, I didn't speak to them. I am looking for advice on how to proceed please.

  • Have they cashed the Ј1 payment sent with the CCA request?
    I would wait for them to write to you and then reply to say remind them that they have not fulfilled your CCA request of x date. I wouldn't discuss it by phone at all.
    Some people recommend writing to them to say you waiting for them to fulfil your request and until they do so that you consider the debt to be in dispute.
  • No they didn't cash my cheque, they just wrote to me to let me know that they would chase the originsl creditor
  • Ignore them. If they write, just respond stating you are waiting for the CCA and until then you consider the debt in dispute, as per Tixy. They will soon get the hint...
    If they threaten court, you can send a stronger go away response.
  • New development today.
    I have had a letter from the creditor (dated 4th September) and DCA (dated 8th September).
    The creditor (NRAM) has stated that they're taking the debt back from the DCA (McKenzieHall) as I have failed to comply with my payment arrangement and want me to set up a new arrangement.
    The DCA have written me stating that I have failed to comply with my payment arrange and want me to set up a new arrangement.
    And to make matters worse, they have written to me about the wrong debt. I have two debts with the DCA with different reference numbers. I stopped paying the one that I hadnt received the CCA back for, but kept paying the one they did send me the CCA for. I have bank statements showing payments with the reference number. So I can only assume that the DCA has been putting the money I have been paying to the wrong debt. Talk about incompetent!
    So what do I do, write to both with a partial copy of my bank statement (only showing my payments to the DCA for the debt that I am still paying towards) or??

  • I would hit the DCA with a written conmplaint, stating that you have 2 debts with them and they have assigned the money to the wrong one.
    Send the proof you have.
    Tell them you expect this to be corrected, irrespective of whether the debt has been recalled by the creditor.
    Mention you will refer to the FOS if they do not correct the issue within the specified timeframe!

    How does this letter read?
    Dear Sirs,
    I write to you in response to your letter dated , advising me that I have broken my payment arrangement with yourselves for NRAM.
    I write to complain as I have not broken the payment agreement for this account. Below are excerpts from my bank statement showing these payments to you;
    And as you can also see below, your account details are correct, as taken from the back of your previous correspondence to me.
    It is my belief that these payments have been processed by yourselves incorrectly, possibly against the other agreement that I have with yourselves.
    I expect you to correct this within 7 working days of the date of this letter, irrespective of whether this has debt has been recalled by NRAM.
    If you do not correct this issue within the 7 working days, I will refer this matter to the Financial Ombudsman Service.

  • You need to give them 8 weeks before official FOS action.
    Just skip that bit, or say the allowed timeframe.
    Other than that, looks good to me.
