A question about : eBay Returns

I had sold a phone on eBay with a small fault, clearly saying the phone could only charge when switched off and connected to mains power.

A purchase with a new account is complete, money clears, hear nothing back for about a week.
Suddenly a case is opened and a return is started. After stressing to eBay i described the faults they still sided with the buyer forcing me into accepting a return.

The item returns today, the phone is now passcode locked, fake accessories are swapped for the genuine ones.

I am at total loss on what to do, ive traded on eBay for years and felt totally exposed to a scam that had left me over drawn on my bank account, a phone that is now worthless, fake accessories and they have a number that is fake on their account that does not connect.

  • Contact ebay to say incorrect item has been sent back.
    Did you take good photos before hand?
    Your next step would be sending the buyer a letter before action, giving him 14 days to return the correct items before you take him to court for the cost of replacing them.
  • feda, have you checked the imei (if you have a record of it) to make sure that it is the same phone that has been returned? (you will probably have to connect up to a computer to restore the phone back to factory settings to do this).
    The reason why it might be showing as being passcode locked is if the buyer switched the phone that you sent for an old one they had.
  • I've done a check on this and its the same phone, however the iCloud lock WAS still there, managed to get around that though. After a long 35 mins on phone with eBay explaining i had received the different accessories than i posted i was told they have no liability for this and i cant prove they wasn't the ones i send. I would advise all to be aware of this, i used the logic to them off that if i bought a Prada bag said it was faulty and sent back recorded delivery a carrier bag would they find this acceptable? To which they said there was no way to prove one way or another what had been sent as all they look for is a recorded delivery notice. So to all please be aware, ive been stung but wouldnt wish this on anyone.
