    After a long and painful relationship with a National bank, and having defaulting on a few loan payments for Ј3500 due to illness, they now have me over a barrell for the for the princely sum of over Ј7000, due to interest and the such like. Does this sound right?

  • Hi there. I am a student banking with Natwest. I purchased an item using Direct Debit from PayPal for Ј4.50 on the 22nd Feb, and the charge was not debited until the 28th Feb. During this time my funds became insufficient for this Ј4.50, although I did attempt to remedy this by being transferred Ј25.00 from a friend's account which I thought would only take 1 day. This Ј25.00 came into my bank on the same day that my Ј4.50 PayPal was taken out, although apparantely the Ј25.00 did not count as part of my balance since it has to be at least 1 working day in advance to count. So I was still "insufficient" for the Ј4.50.
    I have been charged Ј38.00 in total (I think that includes the Ј4.50) for this.
    Since I am in Scotland, can I contest this? Can someone point me to a piece of legal document which I can read to Natwest on the telephone so they are perfectly aware of what I am saying? Even the name of a document I can reference.
    Any help is SO much appreciated. Thanks!!!
  • Does all this apply to fees charged by credit card companies if, for example, you make a late payment?
  • Yes it does. Or indeed anywhere where you have been penalised for breach of contract.
  • A couple of phone calls and a visit to the bank and I had the Ј1 transaction fees for using my debit card abroad refunded by Lloydstsb. I wasn't aware of the charge and if I had known wouldn't have used the card when I did so many times. Some of the transactions were for less than Ј10 (I had just run out of cash and no machine around) so Ј1 a time was a bit steep.
  • I was recently charged Ј30 by my mortgage company Alliance and Leicester. I wrote a cheque to make an overpayment and transferred money from a savings account to my current account at the sametime. Unfortunately the money did not arrive into my current account fast enough. I rang the bank, who agreed to return the cheque unpresented. Alliance and Leicester then received the cheque back. I informed them what had happened and they presented the cheque again. I was then informed that I would be charged Ј30 for this.
    Am I eligible to complain about the charge and try to get a refund?

  • I would say so - we don't live in a Nazi society yet (not quite anyway).
    You can complain and try to get anything back - however, in this case I think you may have a case for claiming Punitive v Liquidated.
    Is there a clause in the A&L contract that says if this happens they will charge you the Ј30?
  • I've checked the mortgage contract and cannot find any information on charges. I'm going to try and get a refund for it. Thanks.

    This is my first post so be nice please.
    I currently have a joint premier account with my wife at the Alliance and Leicester, I also have a sole premier account with them , a saving account and a childrens savers account.
    I get paid into my joint account and then transfer an monthly amount into my sole account, from there I pay regular standing order to my childs account and my savings account.
    Last month (Feb 2006) was a huge bills month month for my wife and I which made me overdrawn up to my limit on the sole account. Not for the first time I might add in my 5 years with the A/L.
    I get paid on 28th of each month and transfer my money the same day. My direct debits start on the 1st of each month. Normaly this gives me a couple of days for my transaction to go through.
    Today I recieved a letter through the post telling me that because I didn't have enough cleared funds on the 1st March 2006 for my transfer of Ј50 to my savings account and Ј20 to my child account they were charging me Ј25 each for a paid transaction.
    When I contacted them they said that they had already given me a gracious payment rebaite a year ago for the same problem. I asked them what had happened to my money int the 24 hours between my payment in my accounts and was told that the money needs to be cleared for 24 hours before they can accept it to pay from it. As it takes overnight to clear this was not 24 hours so the funds were not clear.
    I have now paid my overdraft off and closed the account as I'm disgusted at the attitude of A/L.
    My view is that this is my money being paid as cash into their own bank accounts from their own bank accounts. Where has my money been in the preceding 24 hours to fail to get into my account, which has ended up costing me Ј50 to save money with them.
    Am I mad or wrong in feeling this anger at the A/L. What can I do I've now applied for a sole account with another banking organisation.

    Does this also apply to going over your authorised overdraft? For example if I go over my authorised overdraft by 1p my bank charges me Ј30!

  • How do I find out how much I have been charged if I don't have all of my old statements to hand?
  • Make a Data Protection Act request to your bank. They have to provide you with the info going back as far as 6 yrs, and can charge a maximum of Ј10 for doing so, so don't let them give you any !!!! about Ј5 a statement or such like.
    Make sure you ask for all available transactions and charges, as they'll try to say it took 2 people to intervene manually on your account every time they accepted/refused a transaction, and you therefore want them to show you where it says so on your file (they won't be able to )
