A question about : Can I Get My Money Back?

Hi all, I'm new to the forums, glad to be here :-)

I am wondering if anyone might be able to advise me. I am disabled & back in 2012 I had surgery to pin my hip into place. The surgery was a huge success, so much so I went from being severely disabled to being much more able & mobile, although I was still disabled. Having been out of work for many years I knew I would find it nigh on impossible to find a suitable job so I decided to look into getting involved in property - my plan being to source property for others initially until I had enough saved up for a deposit. Knowing next to nothing about property investing I signed up for some courses with Progressive Property. I thoroughly enjoyed the courses & felt this was a field I could commit to. I travelled several times up & down from Edinburgh to Peterborough.

I was persuaded to sign up to their VIP Property Mastermind programme, a 12 month programme of property based coaching & further courses, based at their offices in Peterborough. Sadly my hip got bad again & my health took a serious turn for the worse. I was no longer able to travel to Peterborough, nor was I able to do any property related work in Edinburgh.

I still owed money on the VIP Program & started paying back Ј20 a month whenever their assistant called me. The calls stopped & eventually I got a demand for the balance owed. I wrote back explaining my situation health-wise & that I did not feel I should have to pay money for a service I never received - my health had deteriorated before I had been to a single VIP night or VIP course. I requested that, under the circumstances they refund me as a gesture of goodwill. I was going to be unable to use the VIP programme so it seemed unfair they should charge me for it. They replied that I had signed a contract & had been given 14 days to cancel. But the point is my health went *after* this period of time & I don't think it's right I should be in debt when I haven't used the product. They haven't chased me for the balance due, for which I am grateful, but can anyone advise me on my right to get a refund? I suspect I have none but I am seriously struggling financially & that money would help me so much. I also, at the same time, signed up for a coaching programme, which I have fully paid for but once again am unable to use due to my health.

Thanks in advance for your help. Sorry if this is a bit long!!

Best answers:

  • Its very unlikely you would get a refund, you did sign a contract
And in all honesty it isn't their fault that you became ill, and they do have 6 years to chase you for the balance.
That, as far as I know is the legal stance, but they may show you a gesture of goodwill.
