A question about : Alliance & Leiscester / MBNA

Hi there,
I was wondering if anyone can give me any advice on an issue with Alliance & Leicester PPI.
I have been helping my mother with her claim for a credit card from 1993-2006. We contacted Santander (who now own Alliance & Leicester) who said to speak to MBNA as they own the credit card side of the company. I did so and spoke to the guy who agreed it appeared that the ppi was mis-sold, and they would investigate the claim and get back to us. We had a letter through 2 weeks later from MBNA to say that when they took over A&L my mother was given the option to cancel her ppi, but as a good will gesture they would pay back the ppi from the date they took over, and the next day a cheque arrived for Ј600 (based on a card limit of Ј1000).
It also said in the letter that while they will pay from the transfer date, they are not responsible for the previous period before transfer, and as such will pass on the claim to the previous lender who should contact us in due course.
This is where we are left confused. I believe that if a banking company takes over an asset they are liable for any previous dealings the company may have had. As A&L are now owned by Santander I can only assume this is who they will have passed the details to. I also assume Santander will say they are not responsible which leaves us wondering wether to cash the Ј600 cheque or not.
Looking into it, MBNA took over in 2003, which I think makes sense for the amount they've paid. Which would mean there is 10 years worth of PPI my mother would have paid.
Has anyone had a similar experience?
Sorry to waffle but thought I'd put as much detail in, it might be worth pointing out that my mother has no paper work from 2003 previous, we know the exact year the card started (1993) from our conversation with MBNA.
Also one last thing we noticed was that for some unknown reason, accidental death cover appears on statements from late 2003 to 2005, at Ј8 a month. I mentioned this to the guy from MBNA who said 'oh, yes, that is strange, I think you will be owed quite a big one. We've heard nothing more on that note.
Thank you for taking the time to read this, any advice would be massively appriciated. I know Ј600 a lot of money, but if my ma is owed more We want to make sure!!

  • Give the FOS a call and ask if you should accept MBNA as they have passed the previous PPI complaint back to Santander, best to know where you stand with this.
    Santander may pay you the other PPI, you never know.

  • I'm in the same position, got the same response from MBNA. I've taken the money but that was some months ago and have not heard any more. When I phoned MBNA they said they'd passed it to Santander but they say they didn't buy the credit card side, so I've no idea where the details were sent. I took out my card in 1999 so have 4 years of PPI to claim. Advice on here is to go to Ombudsman so I'm going to do that. It's very confusing.
  • Hi, its interesting to read the varying responses received from MBNA by others posting here. I had an A&L credit card that was converted into an MBNA card. It had a PPI policy. I submitted a complaint to both MBNA and Santander (A&L) using advice from this forum.
    I got a reply from Santander (A&L) saying that MBNA took over in 2003 so they aren't responsible for anything after that. They also said they no longer have any records of the pre 2003 period as its more than 6 years. Sadly I don't either. So no further action or redress.
    MBNA rejected my complaint with a "Final Response" (which was the first response) saying that:
    - A&L made the sale not them
    - When they took over they sent me a letter giving me 30 days to review and cancel the policy.
    Am I right in thinking that the first reason is irrelevant? Also although they took over the card in early 2003 the card wasn't rebranded as MBNA until Nov 2009. During this period the T&C's of the card didn't change and I don't think that I was even aware that the ownership had changed. In Nov 2009 they actually sent me a new card with MBNA written on it. At this point they sent a glossy marketing type flyer with the new card (which I still have) extolling the benefits etc. There was a small paragraph simply saying that the PPI would continue but under a new insurer and that a certificate would follow with T&C's. It doesn't mention cancelling and it also doesn't mention that the cost of the PPI increased at this point. I never received the certificate or the letter.
    I do have statements and correspondence from Jan 2005 to Dec 2010 when I closed the account. Despite the "Final Response" I've sent a big envelope with photocopies of all the statements and critically the letters disputing their rejection. That was 3 weeks ago and I've heard nothing.
    Question: Those who have had MBNA PPI card reclaims upheld where the card was previously A&L. What actual grounds was the complaint upheld on? Did they say they offered you the chance to cancel?
    I think they owe me Ј4800 including credit interest and 8% etc. I'm quite keen to get it.
    Any advice gratefully received.
  • I had an Alliance & Leicester Credit card which started in 1998 to 2010 I filled in forma and sent them to Santander who returned them with a curt note saying they could not investigate as Santander Cards does not finance this account. No explanation or help, I have heard they were finance through MNBA do I resend forms to them or complain about Santander to Financial Ombudsman as everything I have has Alliance & Leicester on it and they were taken over by Santander so I am very confused.
