Decree Absolute

A question about : Decree Absolute

Can a solicitor withold a Decree Absolute due to an o/s account ? My bill was twice the original estimate and I am paying in installments but can not get the Absolute certificate released until settled.

  • They can withold it but I'm sur you can get a copy from the court for a small fee.

OK, I'll try to keep this short.......

My partner discovered religion about 3 years ago (after previously being quite anti) She talked me into going with her a few times, but my feelings remain the same, so after quite a bit of arguing (and a resultant quite rough patch) we both accepted the others viewpoint, so she goes on a sunday and to a church group one evening a week.

A question about : Court Costs

Can someone advise please.

If you go to court to fight out finances in a Divorce Settlement, does the losing party have to pay the others costs

Solicitors are acting for both parties but this issue has just occured to me.

What are the rules on these Costs and does the loser have to pay these on top of their own legal fees?

Any advise appreciated.

I am not entirely clear about the interrelationship between planning for Inheritance Tax purposes, and trying to alleviate the 'going into care' black hole. I understand if I gift money to my children it will not count for IHT purposes if it is done more than seven years before I die; but does this count as 'wilfully depriving' oneself of assets for the Local Authority capital calculation?

Buying out in Divorce

A question about : Buying out in Divorce

Hope someone can shed some light on this situation!

If a woman is buying the man out (in a divorce settlement) should the man be expected to pay half her costs of doing this?
She wants him to pay for a survey (house was originally surveyed when they bought together) and all fees associated with her buying him out.

Surely they are her costs as it is her new mortgage.

He realises will have to bear the costs of having his name removed from the original mortgage.

I've been married 27 years and started to feel guilty about something I should have sorted out decades ago.

I owned a house in my own name before I was married. Through inertia I left it that way when I married, and even when we moved house 26 years ago everything was left in my name on the new house. The mortgage is now paid off and I've realised I need to make sure my wife doesn't have problems in the event of my death.

First question is, do I need the services of a solicitor, a conveyancer, or someone else?
