Debt after Death confusion.

A question about : Debt after Death confusion.

Hopefully I have posted this to the correct forum.

Here's the details first.

My mother died in November 2014, leaving debt with MBNA, today I received a letter from DrydensFairfax solicitors who are acting on behalf of Arrow Global who have bought the debt.

The problem is that the amount left after the funeral expenses is not enough to settle the balance, there's also 3 other debts to take into consideration.

Here's what I have thought, having nothing to back this up.

My mum passed away recently and left a will in which I am the executor/sole beneficiary.
She has 3 accounts with the Halifax and a property which at this point in time I don't want to sell.
Looking at the forms I can see though it's not straightforward I wan to do them myself and I think it's do-able.
I was wondering what to do about the house, do I have to pay someone to value it properly or do I estimate the market value myself?
I imagine her total asset to be around Ј200k well under the threshold.

Hi,

I have conflicting advice re buying a house using the funds from an active trust.

A solicitor is telling me I need certain documentation that I can't find any evidence of legally needing within any Trustee Act information anywhere.

Any help available?

A question about : Mum and Dad died.No will left. Only one child.

My wifes mum and dad both passed away recently within 5 weeks of each other. My wifes an . only child. No will has been left.

In a situation like this should she apply for a letter of administration herself or should she seek a solicitors advice and help.

A question about : Definition of "in a timely manner"??

Deceased left no will, was unmarried and had no children. Elderly mother still alive and becomes sole inheritor under intestacy laws.

However, elderly mother is a bit vague and unbusinesslike and has not yet applied for letters of admin. She says there's plenty of time and she's still grieving (which is fair enough).

Hi all,

Sorry, just another post from me (again)

I submitted my application for LOA two weeks ago and it was returned to me last Monday stating that I filled in the form wrong by putting my dads death in service in the wrong box.

I called the helpline I was told to call for guidance. Once lady told me to include the death in service in 11.3 and another advices me that I do not need to add it is a discretionary benefit.

We have a family member who has died a widow with no children.

She has divided her estate between 8 beneficiaries (1/8 each) who are all named.

My query relates to the wording for one of the beneficiaries, one of her brothers, who has decreased:

One part to Mr Bloggs absolutely

Mr Bloggs has a widow and two surviving children.

A question about : Death Certificate (interim) copies?

Hi,
Ex wife has died and helping my daughter deal with her affairs, due to the circumstances of the death (sudden and at home alone) an inquest is to be held, an interim Death Certificate is to be issued.

We need to provide a death certificate to the pension company for any potential death in service benefit, assume they will need an original not a copy of the certificate, but the coroner only appears to send one.
