Dying intestate with a joint mortgage

A question about : Dying intestate with a joint mortgage

I have a joint mortgage with my Mum. If she was to die intestate, would the equity in the house automatically go to me, as the other person named on the property, or to my Step-Dad, as her next of kin?

I know that usually when someone dies, the property goes completely to the other person named on the deeds but someone I was speaking to thinks my Step-Dad could claim for it (not that I think he would).

Hi all,

I have a issue that I would like to seek advice on.

My dad passed away on 10th of this month. He had no will and he was not married and had no civil partner. Now since my dad died, his family have not gotten in touch with me to find out how I am and if I need any assistance with funeral arrangements or how I am doing generally.

Hello everyone.

My dad died roughly one year ago to the day. It was all very sudden and is still difficult. He had left a will which left everything to my mum.

His workplace pension paid out a lump sum of around Ј35000 to my mum. She is terrified that the tax man is going to send her a letter demanding her to pay tax on it. She hasnt declared it to the taxman yet, it is currently sitting in a savings account doing nothing as she is very worried about the tax man coming knocking. So....

paying for works on discretionary trust property

A question about : paying for works on discretionary trust property

The family have a discretionary trust which contains a house, the house now needs a new roof, has anyone had to deal wwith withdrawing funds from other parts of the trust to pay for the works?

What forms, deeds do we need to sort out so we keep tax man and law happy?

If we pay for the works from our savings what problems does this cause later down the road with tax and closing the trust?

Finally do we need to pay the solicitor again to do all this?

A question about : Unbanked gifts prior to death

OK, enthused by the fantastic response to my first query in here...

My Dad was in the habit in the last few years of giving my sister and I Ј1500 each every Christmas, alongside some smaller gifts for our children's savings accounts. He died just before Christmas, but had already written all the cheques and cards out, dated two days before his death. Can't bank them, accounts already frozen. Can I deal with them as a debt of the estate (thus reducing the IHT liability on it)?
