A question about : You may be able to Claim through Travel Insurance!

I have been following Martin's advice re flight delay compensation for some time, and although I'm still waiting for the conclusion to my claim, I thought I would share my experience so far as you may find it useful.

Background - My family and I (5 of us) were flying from Stockholm to Los Angeles in July 2014, Norwegian Airline, having originally got to Stockholm from Gatwick, the flight was delayed for over 4 1/2 hours, so with the distance being over 5500 miles we thought we were perfect candidates (maximum compensation would apply).

I emailed the airline using one of the templates supplied by this site, received a reply from them a few weeks later stating that it was due to another plane being faulty so out of their control so I informed them that I will pursue using a lawyer.

I decided then to find a no win no fee specialist lawyer, and there are loads out there, one firm in fact made a cold call and although I wouldn't normally take cold calls but thought I would try this time. Having received their paperwork, the deal was that they would keep 27% plus vat of any payout so I agreed as I had nothing to lose, but when I checked the company I realized that they had only been going for 6 months so no accounts submitted to companies house and probably didn't have a lot of experience (I couldn't risk using a company that keep potential compensation then going bust) therefore I didn't feel comfortable and then.

I remembered that when I pay for holidays/flights using my Natwest Gold Mastercard I am automatically given travel insurance at no extra cost, so I decided to check with them to see if it included Legal Help. To my surprise and joy it was included. I spoke to the legal team and they agreed to pursue my claim using one of their lawyers at no EXTRA COST TO ME, so any and if there was a compensation I would then keep 100%. Instructions and all paperwork is now with the lawyers and I am just waiting with my fingers crossed.

BOTTOM LINE IS, AND WHAT I AM TRYING TO SAY, IS THAT IF ANY OF YOU HAD TRAVEL INSURANCE WHEN YOU FLEW THEN CHECK AS YOU PROBABLY HAVE LEGAL COVER INCLUDED, SO NO POINT SENDING TEMPLATE LETTERS ETC BUT JUST LET THE LEGAL GUYS DEAL WITH IT FOR FREE.

  • You said you agreed to use the claims company - I trust you did not formally instruct them before going elsewhere?
