A question about : Where would I stand?

Hi,

I'm not too sure whether someone may be able to help to put my mind at ease.

Basically, there has been an argument in the family and my brother and his partner have cut themselves off from the rest of the family (there was a small disagreement that blew out of all proportions and they've not apologised for their part at all).

Our worry is that as they are the executurs of my nan's will
Do they legally have to distribute the estate as requested
Can they now turn round and say they do not want to deal with the will
Do I have a right to see copy bills etc to ensure that they are not ripping off the estate?

I think it is important to clear all of this up before we need to (my nan is 89 and not 100% health wise title=Frown ). The estate is worth about Ј5k so it's not a fortune (we believe that nan should spend the money on herself title=Big)

I don't want to come across as money grabbing or such like but when my father died (7 years ago) I was on auto pilot and not thinking for about 6 months afterwards (hence my debt) and I just want to get things clear in advance.

  • After the funeral has been paid, there won't be much left to worry about but of course the executors have to comply with the law. If they don't want to be executors, they don't have to be.
  • I agree the funeral will take most of the estate , and they can relinquish executor duties should they wish. If Nan spends the money you won't need to worry about it anyway.
