Contractual interest

This is what you see on your bank statements charged by the bank when you go overdrawn. It appears on your statement as 'INTEREST', or 'INT'.

There are normally two different interest rates charged. A lower rate is charged when you are overdrawn, but still within your agreed overdraft limit. Under no circumstances can this interest be reclaimed. There is a higher rate of interest (up to 29.9%) charged when you go over your overdraft limit (unauthorised overdraft). This is a bit trickier to deal with. You cannot claim any of this interest if your spending has caused you to go over your overdraft limit, but you can claim this interest on any bank charges that have caused this. The problem with this is working out the interest only on the charges. It can be difficult to get right, and you have to be very accurate with your figures in case the bank at any stage challenges them. Generally, most people don't claim this interest.

    This is my first visit and wondered could anyone tell me if we will be entitled to claim back our banks charges that we have incurred for drawing money out of our local ATM (we live in France). The bank has charged us for currency change and also another charge which we dont really understand. Over the years we have paid the bank an horrendous amount of money!

  • You can't claim back ATM charges in UK or abroad and the other charge is probably for using the ATM. You would be better opening an account with a French bank and transferring money into it on a monthly basis for daily use then you shouldn't have to pay ATM charges.
  • Hi there, I have checked the original post and cannot find this, Alliance & Leicester have charged £25 for 'Payment Review Fee-Item Paid', and £34 for 'Payment Review Fee - DD Returned'.
    What are these charges & can I claim them back? Is it the same as the unpaid DD fee?

  • you cant claim back interest, as in theory you would be having a free overdraft facility. --> that would be like taking out a loan, and not paying interest...
    and the interest charges arent really unfair depending on the overdraft limit you have on your account. normally when a branch mis-advises you, you would need to go back to the branch and discuss that with them...

  • Over the last five years (im based in scotland) i have had several late fees put onto my mortgage account because the monthly mortgage payment has been even a few days late.
    Do these count as "bank charges" that i can claim back??

  • Hiya, I was just wondering if any one could help me with this point, I have recently applied to my bank for details of charges and they have supplied me with the details requested. However since receiving these I have further accured another 4 charges, can I request another list of details which would include the 4 recent charges made or do they have the right to say they have already covered my request. Any help would be greately appreciated.
  • hi netty s/land, i think the point of asking for a rundown of your past charges is only for your records so you know how much your gonna try and claim from them. So in thoery all you need to do is manually add on the new 4 charges, bearing in mind that you may only be able to claim 5 years FROM the date you submit your actual claim. i think this forum is a bit slow in response time. Being a member of other forums normally gets a reply within the hour. So if anyone can look at my post above and help me out, it would be appreciated. i.e are late morgtage charges counted in these claims???

  • Hello, sorry for sounding stupid but can you really claim back charges from the bank for late payments, going overdrawn and going overdrawn when you don't have an overdraft? (even though it's my really fault)?

    Double checked my bank statement and my mortgage payment had gone out
    making me overdrawn on my overdraft...two days later my pay went into the bank automatically.
    Rang up about it to query what the Ј50 was actually for and was told it was because I had gone overdrawn.............can I claim this back ? I don't want to go into our local bank and cause a fuss as we get on very well with the staff there but I do think this is a bit much.I'd been to the bank a few weeks back explaining that at the moment we were struggling.........I was given a 'flexible loan' account so that I could top up the current account if needed so I suppose it was my fault I hadn't done that but I thought our pay would be there in time to easily cover the mortgage.
    It does seem a bit like take the umbrella away when its raining.....the bank know we're going through a sticky patch so add to it with these charges.
    If I can claim them back all well and good..........or do I have to cut my losses?

  • how do i go about reclaiming Late payment fee's from a store card , should i just use the bank charge letters but change them to 'unlawful Late payment fee's ' and do i do the same as bank charges as in, sending with 10 pound check asking for a list of charges then after reply send a request for the full amount to be refunded?

  • I have entered into a repayment agreement with several credit card companies and one loan, is it possible to claim back charges previously impossed on these accounts prior to the agreement being set up.
    if by claiming charges back from these account adversely affects the agreement i'll not bother
    any help on this matter would be greatly appreciated.
