Contractual interest

This is what you see on your bank statements charged by the bank when you go overdrawn. It appears on your statement as 'INTEREST', or 'INT'.

There are normally two different interest rates charged. A lower rate is charged when you are overdrawn, but still within your agreed overdraft limit. Under no circumstances can this interest be reclaimed. There is a higher rate of interest (up to 29.9%) charged when you go over your overdraft limit (unauthorised overdraft). This is a bit trickier to deal with. You cannot claim any of this interest if your spending has caused you to go over your overdraft limit, but you can claim this interest on any bank charges that have caused this. The problem with this is working out the interest only on the charges. It can be difficult to get right, and you have to be very accurate with your figures in case the bank at any stage challenges them. Generally, most people don't claim this interest.

    I have just received a copy of my statements from rbs. there is a number of referal fee charges varying from £25 to £100 as you state above these can be claimed back also. this is on a business account i had with them. any help would be grateful.
  • when reclaiming bank charge, what about FEES?
    ie service fee of Ј6 pe rmonth. Is this reclaimable?

  • Hi I am a new member so please forgive me for being a bit slow, but can any one help me. I bank with lloyds tsb, and have overdraft usage fee charges, unauthorised overdraft fees. has anyone claimed theese back sucssesfuly. thanks Ian.
  • Dear folks,
    I am claiming against LloydsTSB, and their solicitor has informed me that the bank are going to Defend the claim.
    After reviewing the banking charges that I am trying to win back, I see that my claim includes both; Penalty Charges for going over my overdraft limit etc,
    but also Account Service Fees, the fees that automatically comes with the account, and you have to pay the same amount each month (this website suggests that I can't claim for this).
    Have I sabotaged my claim completely, or will I still be able to win back the Penalty Charges only?
    Your help would be appreciated.
  • Can you claim back fees on defaulted card / bank accounts?
    I had several credit cards and a HSBC account that I collected lots of charges on. Then defaulted. I have settled all these now with collection agencies (It can be done folks keep going!) but am wondering if I can claim back the charges i paid?

  • I have had my statements come back from Barclays and I have re calculated the charges BUT my question is.........can i also add on the interest they have charged me on the statements? I know I will be adding a percentage on when alculating but if they hadn't charged me all these fees the interest wouldn't have been so high on my account. So..... can I include the interest charges on my statements when calculating my figures and then also add on a perccentage??

  • Hello hope someone can help i have received copies of my bank statements from first direct. While going through them to total up charges i have got myself confused. Can i claim for the overdraft fee as well as the excess overdraft fee? If anyone can clarify this would be much appreciated many thanks in advance!:confused:
  • can you reclaim cleared transaction charges ie a cheque is paid when you dont have enough funds to cover it.

    I'm claiming the excess fees back. I think the only ones you can't claim are the management fees.
  • I dont know whether this is in the right place, but i've read all of the MSE advice on the first pages and lots of the posts. My account goes over the arranged overdraft usually every month and as we have two accounts (with HSBC) one current and one bills, we tend to get charged on both. In addition to the account fee(bank a/c plus = Ј12.95 per month) and interest they charge they apply a "Dr charge/ notified fees/charges" on my account of anything between Ј20 and Ј125 per month. Can i claim for this???? or should it just be proportionate to the amount i go overdrawn. What is proportionate???
    Sorry if this is repeated advice and a silly question, but i have looked and looked to try and decifer whether i could claim or not.

  • Just got my charges back from Lloyds. I'm slightly confused as to which charges I should reclaim. Below is is what I think are reclaimable charges.
    Am I correct in thinking this?
    O/DRAFT EXCESS FEE 25.00DR
