A question about : West Midlands Debt Agency and old CCJ's

Hi

West Midlands Debt Agency have been hounding me for months about a creation duet card I had. I have queried the large amount of debt with them from what was owed on the card and repeatedly come to an arrangement with them, but for one reason or another have not been able to pay. I have explained this and they told me I made excuses each month. After 5 years of hearing nothing they suddenly got back in touch ! How do you deal with these people they are rude and insulting and I am sure operating illegally. How do I query what Creation say I now owe ?

Also I have an Orange phone and Next card CCJ that have now fallen off my credit report they have not chased these for 6 years are these now statute barred and am I best contacting the company and saying they have old accounts which had CCJ's on them and paying them off? Will then even show now and will they affect my credit rating ?

    Yes they did send me a CCA if that is where you mean you get a copy of the agreement and all the account information over the years. The debt is now Ј4250 and the card started at Ј1150. I really don't think or believe I owe this much in interest and charges !
  • As for the 6 years with regard to the CCJ if I don't pay off the CCJ can the original creditor still see the debt ? Or is it wiped from my file altogether?

  • You asked how to deal with these "rude and insulting" people (i.e. West Midlands Debt Agency). The answer is to deal with them by letter. You will be surprised how much more civil they are. Write them a letter requiring all communication to be strictly in writing.
    Did you offer this payment that you haven't yet made in writing or over the phone? And if you offered over the phone have you actually paid anything at all?
    Regarding the CCJs I would let sleeping dogs lie. But be aware that, as others have said a CCJ may drop off your credit file but will never be statute barred.
  • Interestingly West Midlands Debt nightmare did not start chasing me again until now. They had left it since 2009. My only thought is they have realised the default is due to drop off in 2015.
    Also with the comment let sleeping dogs lie, I phoned one of the debt agencies I was paying one of my CCJ's to, to check what the status of my account was.............they told me they handed the debt back to Next in 2010 having held it since 2007. The CCJ was placed in 2008. Therefore Next have not taken any action since 2010 and the debt agency have written it off (Moorcroft). Orange have no record of any old account on file and neither do EE so I am very tempted to keep sleeping dogs lie !
  • Sorry one final thing. I have one account that has a default expiring in 2015 but it also says it has been debt assigned to a new company will this mean the DA notice will stay on till 2019?

  • If I have a default then it will fall off after 6 years then but what about a debt assigned notice -how long will that stay on my file.

  • Sorry if I wasn't clear.
    Unless a DCA unfairly updates your default date, the whole account drops off your file 6 years after the original default. Not just the default but ALL the history. The whole entry (or slot if you like).
