A question about : Voluntary redundancy query

Hi, hope I'm posting in the right place and that some of you wise people out there may be able to advise me
I was employed for 25 years in the same organisation (NHS) which had extremely good redundancy T&Cs ( a months pay for every year). Unfortunately 2 years ago we were TUPE'd over to another organisation (local government) under a 2 year TUPE agreement. The new organisation is under extreme financial pressure and has opened the option of voluntary redundancy.
My question is, -am I entitled to the NHS T&Cs or the NHS ones? No move has been made as yet to align any of our other T&C's with the council system.
Any thoughts you have would be greatly appreciated. title=Big

  • Based on this - nobody can tell you. It depends on the terms of the TUPE and the employment terms. Speak to your union.
  • I have been in similar position and the Ts&Cs for just about anything were whatever was in the contract ie the original Ts&Cs
    However.... that is compulsory redundancy that you are referring to - voluntary redundancy Ts&Cs are subject to local agreement etc etc and may be different
  • Hi, my understanding is that when you are TUPE'd to a new company its on the same ts&cs, any significant change would require negotiation and you signing a contract agreeing to it.
    I work for a large outsourcing company and we have staff who transitioned from public sector 10 years ago who are still entitled to the redundancy ts&cs of their former company - why would they transfer to our company's terms which are much worse?
    I'm no expert just what I've seen at work... hope it helps.
