A question about : Taking Paypal to the Small Claims Court, possible?

Is it possible to put in a claim against Paypal for money of mine that they are holding for 180 days through the small claims court? The reason I ask is because, although I have acted lawfully and have not behaved fraudulently in any of my dealings with Paypal or Ebay selling, I notice that Paypal as a company operates out of Luxemburg; they do have premises in the UK however.

Can anybody enlighten me, as I have Ј2,700 in my Paypal account but don't want to waste Ј80 in the small claims court - what it would cost me due to the amount I'm claiming - if I have no chance of winning due to Paypal being based in Luxemburg.

  • did paypal say why they are holding the money? maybe get a paypal top up visa then you can just move the money to that, takes approx 24hrs to move onto card then can just use card like normal visa
  • I don't know about your circumstances but there are situations in which PayPal can be taken to the Financial Ombudsman Service - it is free for you.
    Whichever route you chose, allow them to run it through their complaints procedure firs.
  • samll claims is only for amounts up to Ј2000. after that its county court proceedings. you haven't really explained why paypal are keeping your money from you. They must have gave you some reason.
    go to paypal and try and sort it out. county court proceedings could cost you a fortune if you lose.
  • In short yes you can claim in the county court (otherwise refered to as small claims court) for anything upto Ј100,000 i beleive but certainly you can claim for more than your account balance.
    the easiest way is to use the onlione service moneyclaim online which is the official uk courts website. I think your claim will cost in the region of Ј65 - Ј100 which will be added to the amount being claimed from paypal.
    your situation is not unusual paypal routinely freeze accounts and refuse to explain why other than to give a vague statement that you are "high risk".
    points to remember are that you are legal owner of the funds, your agreement with paypal can be ended at any time by you and if you disagree with paypal's reason, or lack of, for holding your funds you have the right to take action to recover any money you feel is outstanding.
    paypal can't wriggle out of court action because they are based in luxembourg as they are accountable here in the uk for their business dealings here and have offices in surrey where any court/enforcement action can be effected.
    if you feel you have just cause and want to persue action then you can do so by yourself or there is a specialist company based in the uk who deal with these claims for you for a fee, not sure how much but i have heard good things about them in other forums, their website is here.
    good luck with it and yes, i have had experience of this myself which is why i know a little (not an expert though) about it, they froze Ј3,500 of my money a couple of years ago and i made a claim after being refused access to my funds, after serving court papers paypal released my money despite being adamant that they would not do so no matter what i did so there is always hope, good luck hope some of the above was useful.
  • please pm me if still need help with taking paypal to court i have done the same due to "selling high risk items" even though i bought and paid for the items in question (womens and baby clothing in case you wondered) i can get you the addresses needed as well to take paypal to court I have lodged a claim and paypal are using common underhand tactics by asking the court for more time for a defence which is just costing them money

  • I need to take PayPal to court over 4k and have a very good case as they refunded clients on the casual CC fraud even though I had signatures etc..

  • Paypal is covered by FOS - see here.
    This means you complain to Paypal, if you are dissatisfied you go to FOS. If you are still dissatisfied then you can go to court but FOS is free.
  • I'm currently taking PayPal through the small claims court.. issued on the 2/7/14 to the Surrey address (many thanks for it by the way!)
    Any help would be great.
    Can see them 'acknowledging it' before the 21st July though of course but we'll see what happens.
    Total amount they owe us is over Ј1.3K
