A question about : Sunday Solution / Bradbury&Co.

They were my accountants and they've retained a lot of money from my salary to pay HMR&C but they haven't paid them yet. I'm being charged for this and Bradbury are making interest themselves.

These two companies have the same director.

The problem is that they haven't paid yet any tax for the period 2007/8 they won't return my calls keeps getting excuses from them, anyone know whats going on or can give some advice about what should be done at this point?

  • I am in exactly the same situation.
    I have outstanding tax liability from 2007/2008 that still bradbury and co have not yet released to HMRC. From forums I have found at least 40 people affected, although speaking to a rather disgruntled employee, who works there, earlier today apparently 1400 contractors have had their 2007/2008 redone and resubmitted - I imagine the majority are affected.
    The company director is a chap, Andrew Nyri. He runs the front company called sunday solutions that gets the contractors in and also the accountancy company called bradbury and co. (sorry as a new user I cant post internet links but they do have websites)
    When I first found out the tax I owed HMRC had not been released from bradbury I tired for TWO months to get through. Then I got another letter from HMRC saying it was about to be reported to local debt collectors. I'm very close to just paying it myself and taking legal actions against them, but i doubt it as that would probably cost more than i am owed.
    I really at a loss who to take this too, this company needs serious investigation and this guy needs to be accountable. Watchdog would have a feel day. I finally managed to get through to him again this week (had to threaten a personal visit). His attitude his amazing, I demanded he sort it out this week and he got back to me to say he had spoken to the HMRC and it had been sorted. Needless to say, I called HMRC DMU and was told that the agent had recorded that he had been 'Very rude, saying we were being unreasonable and then put the phone down'. Beggars belief.
    The thing is they sell themselves as a very professional company, they are not small and have a few hundred employees as far as I am aware. I had no trouble with payment or invoices when using them (i'm paye now). it just getting this damn tax released. I still have the 2008/2009 pain to go through yet.
    So in summary, I owe HMRC money, bradbury has that money but wont release it. crooks.

  • You need to be reporting them to Trading Standards who are probably the only people who can take any action against them.
    Sadly, as you've found to your cost, the term "accountant" isn't protected by law in the same way that "solicitor" or "doctor" is and there is absolutely nothing to stop anyone setting themselves up as an accountant and conning people like this.
    Had you used a "chartered" firm, you'd at least have a professional body to complain to - most qualified accountants pull their finger out when complaints are made to theor professional bodies as they risk being thrown out and losing their valued "chartered" status. Also, "chartered" firms have to have professional indemnity insurance (and the professional bodies check that they have it) to cover clients' losses, which I suspect this firm of cowboys won't have.
  • If the OP and trueaccent get talking in pm's there best option may be to contact trading standards together, a joint action with themselves and any others they may know of might yield better results. Personally i would never give monies to an accountant to pass onto HMRC, find out your liability and write out the cheque to HMRC, no one else.
  • From my side unfortunately nothing has changed.
    They keep promising but they're apparently not doing anything. At least they haven't shutted down their office, that leaves me some small hope.
    I will contact the traiding standard and keep looking for people in my same situations, if we have to find a lawyer it would be better if we can join on this I suppose.
  • I am in a fairly similar sitiaution. My tax is now (finally) paid to the taxman, but I am owed many thousands that Bradbury have retained. I have spoken to Andrew Nyri a number of times over the last 5 months, but now getting any kind of response (to email or phone call) is impossible.
    I was made redundant on Friday so this is no longer just a minor money issue to me.
    Does anyone know Andrew Nyri's address, phone numbers, email addresses? Its time to try an alternative approach.
  • I have had debt collectors knocking on my door, if anyone else has had a problem with them please contact me as we can all group up together against them and get our money back. My close family memeber is a solicitor and advised that it would be cheaper and better to fight the cause together. I had to pay Ј7500 today to HMRC to get the debt collectors away from my house.
    I tried ringing Andy Niery 50 times, he rang me back a few times saying he would ring HMRC and he has not. Also he says he is going abroad as he has health issues, which I totally don't belive.

  • In response to moneylost: There are private investigation type firms that do computer based searches that can get info for you like that pretty quickly and prob reasonably priced in comparison to the amount you are probably chasing him for. I know somebody that works for one called pheonix intelligent solutions or something like that. I am sure if you google them you could maybe get a quote for a search for you.
  • This is a bad situation.
    The trouble is anyone can call themselves an accountant for the purposes of business whether or not they have any qualification, experience or links to any professional body.
    I see from Bradbury's website they don't have any professional association and they appear to be Ltd co which will limit liability for the owners. Most practice firms are some form of partnership. I know ICAEW rules don't require members to have a practicing cerificate if they provide services through a Ltd co. so this is a way of avoiding some of the usual regulation.
    This is a case that illustrates why people should only use accountants with some sort of professional affiliation ie ICAEW, ACCA as this gives you some sway with them as far as needing to give you a professional service.
    To deal with tax payments for you an accountancy provider should be a registered tax agent with HMR&C, I don't know much about this but perhaps you could complain through them. They are likely to have a certain amount of clout that an individual wouldn't.
    It's worth thinking long and hard about who you sign over to be your tax agent as you are giving up control of you own money. It's not actually necessary for anyone to do this even if your tax agent tells you it is - they like it because they can make sure they get paid.

    It appears I am another individual with the same issue and as my GetNyri name implies i'm not a happy chappy. For your information this is what i can make out of the firms in hand:
    Bradbury, Sunday solutions and Willowmeade are all one and the same outfit with the same Directors from what i can make. So all these firms need your attention on the phone. As for the Registered address the Tramshed Bath- NO ONE THERE AS OF 08/07/09. The site Manager of the Tramshed confirmed they moved out two months ago. however there post is still collected in some shape or form. Of course if you ask any staff at either Bradbury or Sunday they say the Tramshed is still there address where they are working from, this was confirmed again whilst standing outside there empty offices- Nothing but lies...........

    I have also had word Bradbury have moved to an office just out side of bath in the village of kenysham....... no address of yet but its only time.
    Does anyone have a list of the Directors names at Sunday solutions/Bradbury? One long email on the 15 days ago and two calls a day and no one will ring me back- funny that
    I would recommend the following steps:
    1.Report both Sunday and bradbury to offices of fair trading
    2. Contact HMRC support and explaing the situation
    3. Legal Advice
    4. Find the locations of the offices, they have to be based somewhere.

  • The new guy that was supposed to fix my issue has been unavailable all the week.
    Anyway we have names... I reckon we can legally make them give back us what is ours.
    I think we should first get together on skype (conference call), listen our stories (they're going to be very similar) and decide whether or not get a solicitor together.

  • I too am being chased by HMRC for 7500 pounds in tax owed - I've called and spoken to Bradbury & Co many times who keep telling me that my tax will be paid. Well approx 2 months later I still have HMRC sending me demand letters and now threatning with Debt collection. I try to call Bradbury & Co but all I get is voicemail now? I've left various voice mails and even sent emails but nothing :-( I am now unsure of what to do, has anyone filed any legal action or had their taxes paid? Please let me know.   • nexuss my freind, I guess we all have low post counts because A I have never posted on this website before (never needed to) B this situation is affecting me and I think it will affect a lot of other people as I believe that Bradbury & Co have done a runner with a lot of people's tax money that is owed to HMRC.
    If you can help with this in anyway it would be much appreciated.
