A question about : should I take them to Small Courts now??

Hi all,

some advice will be v.much appreciated.

last april (thats 2010) I with 4 children were left stranded at Madrid airport by TURKISH AIRLINES.
Our flight was from istanbul to birmingham but cancelled then put on istanbul to barcelona than diverted to madrid.
I had made arrangements in barcelona for accomadation but all this went out of the window!!
Anyway eventually got money wired from relatives & friend came with a people carrier to pick us from madrd.

Been chasing Turkish Airlines now, numerous emails, calls, AUC no luck.

Had enough now.

1. can i claim for onward travel costs & accomadation costs from madrid to UK??

2. as turkish airlines, can i go to UK small courts or is it european small courts

any1 had similar experiance with turkish airlines??

  • What did the AUC say?
  • You may have a serious problem because Turkish Airlines are not an EU airline and the rules that everyone have been using (EU261) will not apply. The airline may not even respond to your proceedings and as they are not based in the UK or EU, you may have difficulty enforcing any court order, if you get one. My view regretably is that you have no real prospect of success in this case, sorry
  • This is a funny one. My gut feeling is you might get a refund or partial refund of the ticket price but you won't get consequential expenses.
  • AUC - numerous emails replying that they have written to Turkish Airlines. I am afraid this is the best they can do.
    basically i paid them to take me from istanbul to birmingham but they left me in madrid. surely this would be good grounds to take this iisue against them as breach of service/contract??
    any non-EU company which operates in the EU, surely we must be able to seek our rights from some source right??
