A question about : Shared care

Hi

Quick question if I may.

What would/ should happen in the following situation:

A NRP situation changes when one of their children comes and lives with them as the child was asked to leave the home of the PWC. (The other child is to remain living with the PWC.)

Up untill now, the PWC claims child benefit for both children and the NRP has been paying the maintenance as agreed.

The NRP will be claiming child benefit for the child now living with them.

Would both parents now be classed as PWC's or NRP's and each parent will be assesed for the other child not living with them? Would both parents be assesed on their indiviual salaries and have to pay the other parent accordingly?

Sorry if this is a stupid question, its been a long stressful day.

  • Thanks for the input. I thought that would be the case.
    My ex has stated that as they are still supporting one of my children then they are happy to accept half of the agreed amount of child support from me.
  • but equally you are now supporting one of your ex's children so you could start a claim against them.
