A question about : Rijo24

Hi everyone, I hope this thread is in the right place.

Ok so I purchased a business, the previous owner has told me that the Rijo coffee machine is on a 5 year contract, the machine would be owned by the business at the end of the 5 years, however on 3 occasions the sales rep failed to complete the credit agreement correctly, on the 3rd occasion I was present although not working for and did not at that point own the business, but I was given permission to deal with this matter, at that point I told the rep that as the paper work was not complete that I wanted the machine removed, he did the typical sales rep thing and tried to baffle me with science, after a few weeks he admitted defeat and passed the matter to a 'Sales manager' who promised to come up with a solution, he never did, I had numerous phone calls with him explaining that it was not a cost effective solution for the business to pay Ј70 per month plus the supplies for the machine as it sells coffee only and my clients will not use the machine, especially as the weather get warmer, he still promised to contact me with a solution, finally I wrote a letter to the managing director, explaining all of the above, I got a phone call from the Sales manager' who has magically turned into a director!?....anyway he now has promised me an email on 2 occasions with a proposal, but as yet i've had nothing.
What can I do now? I have no paperwork for this and do not need it, they have sent an invoice for one months payment, even though the machine has been in since July 2014, its switched off and not used, I haven't paid the invoice.
Please help with this as i'm not sure what my next move should be, I just want them to take their machine away and end all this.

Regards
Neil

Best answers:

  • As its business contract you need to see a solicitor .
  • The previous owner still agreed the 5 year contract, the credit agreement deals with how to pay for the machine and may not be a way out. As said above you need a solicitor who deals with this type of contract to see if the agreement is valid or not.
Being rejected for credit or failing to complete the credit agreement doesn't mean the contract for the machine is not valid, you need to look into this.
  • I don't have a contract, I have no paperwork, I don't know what was agreed, the credit agreement was never signed or completed correctly, that was the only thing I ever saw.
  • Any help with the best course of action here please?
  • There was no solicitor, just an accountant who drew up a contract...
Ok so i'm just wanting to be able to deal with this and send the machine back, any ideas? especially with Rijo being 'Difficult'
  • Is it a limited company?
  • Yes it's a LTD company
