A question about : response from 1st stage appeal

hello and thanks for all help so far.

have just read thru newbies post again, to see it suggests starting a new post after receiving a response to 1st appeal.

Have just received a response to 1st stage appeal from uk cps. It was not the rejection expected.

They wrote saying, (edited relevant bits) if you are the registered keeper, we now have the right to recover from the keeper that unpaid amount.

And You as the keeper have had the right to appeal within 28 day from point of issue of ntk. please note the 28 days has elapsed.

And, YOU MUST NOT IGNORE THIS NOTICE, YOU HAVE 14 DAYS TO REPLY.

It looks to me as if they are saying they haven' t received the 1st appeal.

It may be being over optimistic, but suggesting they haven't received the 1st appeal is (the keeper feels) a weak response. Have looked at postings trying to find something similar to guide, but without success. If they'd actually rejected appeal, the keeper may be more certain as to how to proceed.

  • They are trying to avoid the POPLA fee and suggesting that they have sent you an NtK.
    Fill in a few dates for us - date of contravention, date of any NtK that may have been sent, date of your appeal etc.
  • Need dates....... this is important.
  • OK. They are probably trying to obfuscate things and dating the appeal window from the windscreen ticket date. (This is not a new ploy).
    Write back to them refuting their claim, and laying out the dates (excluding the windscreen ticket - you don't know anything about that. ) Thus your appeal was in time, thus they must do either of the following:
    1) Accept the appeal and cancel the PCN
    2) Reject the appeal and issue an independent appeal code
    Question to the forum - when did UKCPS join the IPC? (The windscreen PCN is dated December 2014 ... had UKCPS already joined the IPC by then?)
    OP - if IPC thus IAS applies, it's your choice whether to bother with an IAS kangaroo court appeal.

  • With IAS, they appear to be picking off people who appeal the the IPA via their "in house" solicitors (all the same firm) .
    Then selecting people for litigation who's appeals they reject.
    The Method of hiding amongst the numbers and been might now be a better option, they are limited in what they can litigate and I would think picking of peoples details they already have on file would simplify things from a admin perspective.

  • No. You write back refuting their claim that you haven't appealed in time.
    I'm not sure I could have made it any clearer.
    But it's all moot anyway ... it's IPC thus IAS kangaroo court, so getting an IAS appeal reference is probably not worth it anyway as any appeal will be rejected. So you're probably into Ignore mode now ... ignore anything from anyone except a compliant Letter Before Claim from UKCPS or actual court papers (from Northampton or Salford).
