A question about : Redundancy

Hi

I am after some advice......

I have been told i am being made redundant with a finishing date of 31st may 2015. I will have worked for the company for 21 years & 6 months, i am 37 years of age. My holidays run from 1st Jan to 31st December i get 22.5 days + Bank Holidays. I have been told i will receive redundancy pay not sure what i am entitled to!!!!

Do i need written confirmation of notice, will i be given my P45 when i leave. Will i need these to claim any benefits if i need to ot to take to another job

If i do not get a job straight away what benefits would i be entitled to.

Just wondering where i stand rights wise with my employer as he is not very with coming with any info.

  • There is a calculator here to work out the statutory redundancy: https://www.gov.uk/calculate-your-redundancy-pay however your employer may possibly offer enhanced terms.
  • Do you have a written copy of your employment contract?
    Does your company have a staff handbook or similar document? If not then ask Personnel / HR. Your manager is the next point of escalation beyond that.

    I don't have a written copy of employment contract.......Never had a contract.
    Company does not have a staff handbook or similar document?
    There is no HR/personnel department there is only 3 of us in the company.
    All i would like to know is my basic rights so i know what he is talking about when we have meeting etc.
    Any info i would be most grateful.

  • no one can give you specific figures unless you say what your current pay is.
    If I understnad correctly, you started work when you were 16.
    You will get 0.5 weeks pay per year worked before you turned 22, so 6 years = 3 weeks pay.
    You will get 1 weeks pay per year worked between the ages of 22 and 40 so 18 years = 18 weeks pay
    However, the calculation only takes into account a maximum of 20 years service and there is an upper limit on weekly pay.
    so in your case, I think you would be entitled to 19 weeks pay (based on 18 x 1 week + 2 x 0.5.week) Only full years count so it might be 17 x1 + 3x0.5, depending in then your birthday is and how many full years since you turned 22.
    You are entitled to notice based on your length of employment In your case, you would be entitled to a 12 week notice period.
    SO the maximum *statutory* redundancy pay you might get (if you currently earn Ј464 per week or more) would be.
    In terms of benefits, if you don't find a new job right away, you may be entitled to Contributions based JSA, based on your NI contributions while you were working. This can be paid for a maximum of 6 months, and if you qualify, they do not take into account you redundancy payment or other savings or investments.
    You may be able to claim other benefits such as housing benefit and council tax benefits, depending on your over all financial position - normally savings f less than Ј6,000 are disregarded.
