A question about : Possibly being blamed for an accident that isn't my fault.

Hi all,

over a week ago, I was involved in a minor car accident involving one other vehicle. The other person came into my lane without indicating, and went into the side of my car. We got out and exchanged details.
Anyway, as soon as I got home, I called my insurance and gave them all his details as well as a statement. A couple days later, I received a letter from kindertons (on behalf of the other driver) claiming that I hadn't reported the accident to my insurers and that this was a breach of my contract, stating that I need to act on this before anything more goes against me. I looked kindertons up, and they offer help for people that aren't at fault. So by the looks of it, not only has he wrecked my brand new car, but he is putting the blame on me!
The one thing that I am worried about is that some insurers can be ageist. The other driver is probably roughly in his 60's that was driving a Dacia Duster and I am in my 20's that was driving a Nissan 370Z Nismo. I'm worried that insurers will take one look at this and immediately think, well she is a young driver driving a performance car, and he is an elderly man driving a sensible family car, she must be at fault. will this happen?
also, if he has put the blame on me, can I dispute this? Can I go further and take it to court?

  • More often than not when there are incidents where there are no witnesses and differing versions of events they end up going 50/50 because going to court would be a simple roll of the dice on if the judge believes one party, or the other, or things both are wrong and a third version is actually the correct one.
    Most claims handlers are actually fairly young and they themselves arent that likely to be prejudiced against you but if the TP maintains their innocence and/ or actually issues then they will consider how a judge is likely to view the matter which does include how credible a witness you would be,
  • Where was the contact on each vehicle as that will come into play as to who could ( whether possible ) have taken action to avoid.
    Check and confirm on google maps the lane markings at that place as to whether there was any kind of merging of lanes, or instruction to give other lane priority (say where it then merges)..
