A question about : Possible Redundancy

Hi All

I think my position is very good, please can anyone confirm my thoughts,
The company i work for are looking to shut down the whole department i work in,they purchased the business in 2012 and i was given a contract at the time they purchased my old employers,it was a TUPE transfer, the contract advises i have 20 years service.

The contract states that under the terms of the agreement my employment commences in May 2012 for a minimum of four years from the commencement date, terminable by either party giving to the other not less than three months notice to expire on or after the agreed period.
I see this as a guarantee of employment till May 2016,am i correct ?? please advise

Best answers:

  • Get your CV updated
    Get a covering letter completed
Start gathering best sources of job adverts for your area and sill set
Look at your sills write them down and get worked up examples of how YOU have met these skills and what the outcome was
    Start applying for jobs NOW
Just X2 check the current position re redundancy (speak to your HR department), as I TUPE'd staff across with existing contract but not Redundancy policy (can not remember details exactly)
  • Looks to me like there is a earliest termination date of May 2016 unless there are other terms that override this.
They do have the option to offer a suitable alternative if your current job goes earlier.
So check your contract for things you can use to counter suitability if you want to leave.
How many have this sort of deal if this has been overlooked it might be best to keep quiet till thye have got a lot further hopefully to a point of no return.
if enough have long termination dates they might be better off just staying open for another year and work through a transition giving the office any old work they can find.
  • Get more, I am the only one in the Department with this type of contract,i work in an Industry where we are client motivated and the vast majority of the clients were my contacts,at the time of the purchase of my old employer,s it suited both parties to have this agreement in place.
  • You don't have anything to worry brother. You have got something they cannot take from you.. Your Experience! Best of Luck!
