A question about : PCN received from ASDA car park in Scotland

Hi folks,

Looking for some advice. I have read the sticky about PCN and I have interpreted as follows.

My son parked my car in an ASDA car park in Scotland and overstayed his time by about 30 minutes. I am the registered keeper

As I am in Scotland the PCN should just be ignored, but I should keep any letters.

Is that correct?

  • Thank you or the prompt reply, much appreciated. PPC I assume is private parking company and this was Smart Parking
    I appreciate that he was in the wrong and should not have overstayed his visit and he has been advised on where to park legally going forward.
    If the advice is to ignore why do they persist is sending out the letters. i assume that many people must still pay.
    I will be ignoring as has been advised. What happens next. I assume a note from Smart parking saying that as I have not paid within 28 days the costs goes up, which I should also ignore?
    Any further advice appreciated
  • Smart are pretty benign in England and Wales and I don't expect them to be any different in Scotland.
    They have got nowhere near issuing court papers in E/W, in fact they back down when faced with a forum assisted POPLA appeal (not available in Scotland).
    So advice is to ignore them, no contact and no indication of who the driver was. You may get some debt collector drivel, but that too is benign.
    Only come back to us if you receive official court papers, or you want reassurance at any stage.

  • Gosh, do I count myself so lucky to have stumbled on this forum? I am going to say positive for now. Thanks for all the information guys.
    I returned home from work only to meet a PCN of Ј70, discounted to Ј40 if paid within 14days. Guess what!? Like the world's most worriers, I flipped, panicked, to say the least and started phoning Aldi to rain brimestones on them.
    I also tried to phone Parking eye but thank goodness it was automated voice and I had to hang up furious. However, my attempt to research for a similar experience lead me to this forum. Now to cut the chase.
    I as a registered owner of a car, got a PCN from Parking Eye overstaying a welcome at Aldi - all for the love of bargains/economical savings and the constant hype in the media between supermarkets. I must say that this is the first time it has been brought to my attention that there are limited parking especially on retail carpark; believe it or not, I have been this naive and not even aware of parking signages.
    Fellows, it is of my understanding that I do nothing but ignore the PCN since it is happening in Scotland. Is this correct? HELP PLEASE.
  • 100% correct. Ignore them but keep the bog roll they and DRP send.

  • Hi, sorry to be repetitive. My wife overstayed in Asda, hamilton car park by 5 mins and 53 seconds. I have received 2 letters from Smart parking and now 2 from DRP now threatening to pass case to solicitors to commence court proceedings if fine (now Ј120) is not paid by 06/03/15. I have ignored them all so far. I don't know if I'm being fined for over parking, as it took my wife about 5 mins to get a space as the car park was full, also add the time to exit once she had left her space and she would have been under the 3 hours allowed, or if it is 3 hours in their car park grounds.
    Please advise

  • Just an update, I have now received numerous letters and now letters from the debt recovery company offering me a final chance to pay a reduced amount.
    Any idea of how many more letters I can expect to receive
