A question about : Pcn

I'm confused.
The story.
My child started a new job and parked the car on a car park nearby, after work there was a PCN. Colleagues at work told my child it's a scam throw away, so it was, and carry on parking there, my child did, gaining tickets every day. We have had lots of ' notice to keeper' letters from TESGB. lots of letters from 'ROXBURGHE' debt solutions and from 'UCS' and finally from 'GLADSTONES' solicitors. Now we have received a county court claim form from the county court business centre. The total bill is now Ј3617.66. Now we don't know what to do next. We have never replied to any of the letters. The court claim is genuine as I was worried and emailed them. Advice would be grateful.

  • op - welcome to mse. You've found us before things become any worse.
    Please add context to your post here i.e. that you/keeper/child are one of the casualties from the collapsed tickets appeals service, formerly run by some former msers.
    That should save you from 'READ NEWBIES STICKIES' flaming but, of course, you must do this reading urgently.
    It won't just slot into your mind instantly - it needs absorption, several readings.
    You also need to learn to use the Forum Search tools. There is no magic wand.
    There's always help and support for people who understand this and show willing.
    You have to do this at a late stage, unfortunately.

  • Hi. In your reply you say about this being a scam, surely if they are using a county court, then it is real. Sorry if i sound new, that's because I have never used a forum before. Didn't know about this forum until 2days ago.
    I have read the newbies item, and I know I should reply with 'acknowledgment of service' to give me 28 days rather than 14. But in defending is where I'm unsure. I have read so many threads and haven't seen any with the same situation as this.
    On advice from work colleagues my child had thrown away all tickets that were placed on car. The car park is permit only parking, and my child stupidly continued to park there, again on advice from there work colleagues. There are 11 tickets dated with amounts due. And a further date that says 'various' that has an amount due of a third of the overall claim. I am unclear if I'm defending as 'unfair amount' to get it reduced , or defending as a scam.
  • Ok. So should I reply to cc claim form, by acknowledge of service, or by ' I despite the full amount' in which case I have to set out my defence, which I am unclear about.

    Any unenforceable invoice, especially one issued by a private parking scumpany, is a try-it-on jfk i.e. a scam invoice..
    This Forum helps you understand how and why this is, how to defeat it, using tried and tested templates on points of law.
    Points of Law are not what [private parking scumpanies deal in.
    It also shows you why you MUST do this, unless you have shares in a private parking scumpany and wish to enrich them further.
    If you do this, you aaccessorise their own proven civil tort.

    Your child's case - and this may just be a first frightener tranche they're throwing at you, DOES need expert help from here.

    Please don't be put off from reading and reading all the links that are given in the Threads. It is the best preparation: knowledge is power and it will also give comfort, in seeing that others have dealt with all of this sameoldsameoldsameold before.
    Again , I ask you to remember - we ALL began like this, with one or more of these unenforecable demands for money.

    Yes I'm slowly starting to get the picture.
    I just kept convincing myself that our case was different because of so many Pcn' s. About 15/16 that I know off.
    Tomorrow I will go online to court and enter 'I dispute all'
  • Hi again. Just letting users know where we are upto.
    We have filed the acknowedgment of service. We know have 25 days left to enter our defence.
    This is the hard part for us, as like most people never had to do this.
    Help or tips are welcome. More reading is obviously needed.

  • just a small note. on reading the 'NEWBIES' #5 about court. just a little confused.
    i have done the AOS online at the court, and ticked defend all.
    i now have to send my defense, this is where im not reading properly.
    At this point is it skeleton or full.
