A question about : ParkingEye-v-Beavis Appeal: Date Set

The date for the hearing of this case at the Court of Appeal is now in the public domain, and has been set for Monday 23rd/Tuesday 24th February 2015. It is extremely unlikely that Judgment will be given at the conclusion of the hearing, but will be handed down a few days later.

Anyone who has a PE court case before that date, should, if the Judge is minded to follow the original ruling, try to get their case stayed until the result of the appeal is known.

  • Nice... Might go down, bit pricey for parking though! I accidentally pulled into a Ј20 per hour car park once

  • Will you be warning the appeal judges not to believe any dodgy phone calls they get from people pretending to be parkingeye employees?
  • If you do want to take the car this is about the cheapest parking you'll get nearby Ј2/hour.
    About 15 mins walk, it's a huge underground car park owned by The City of London never any problems finding a space.

  • Last time I was in a Court with Parking Eye, the Judge very kindly asked them to pay my parking costs.
    The lawyer disputed the Ј3 I was claiming...."Well I don't know he's spent Ј3."
    The Judge, quite rightly pointed out, that he hoped that the ticket proving payment was where it should have been, on display behind the windscreen.

  • Case tracker says 23rd or 24th for 5 hrs, but CoA cause list says not sitting on 23rd, so presume we are looking at Tues 24th then?

  • Interesting read. I don't believe if Parking Eye win itll be as bad as it sounds. I dont believe any pub would charge for drink spillages, and I dont think PPC's will charge over Ј100 even after they get free reign to charge what they like.
    Unfortunately If they loose as Prankster suggests something will have to be done about it. So me parking in my next door neighbours parking bay and getting invoices every week will no longer be something I can brush off with a simple POPLA appeal and I wont get the pleasure of costing the PPC a few quid. In fact I suspect there are many many more on the desks of my lease company waiting to be sent out which could cost me a few quid based on how this Beavis case turns out.....
  • If Parking Eye win this and get the result that the figure is allowed using commercial justification you'll be able to hear the sonic boom from every PPC changing direction, the usual appeals will be declined and invoices will be sent out as fast as they can print them.
    I doubt many other places may change, but they may start using it as an invoice for leaving a bad review for hotels/restaurants etc.
    If PE lose, then they'll need to try harder to find a valid justification, which won't happen (they are already scraping the barrel) and might have to try another approach (charging businesses to actually manage the car parks).

    A certain dodgy budget hotel chain has already tried it on over getting people to pay Ј400 speculative invoices for smoking in their room (even when they didn't). If "commercial justification" is allowed as a means for business to effectively fine people just watch unscrupulous companies falling over themselves thinking up creative ways to boost their profits!
