A question about : ParkDirect

Hi,

I've searched the forum but can't find help for my query;

I sent an original appeal to Park Direct within the 28 day appeal limit which they 'never received' - I only sent as first class so no proof.

I have now sent another which has fallen outside of the 28 days and they have not considered as its out of the time limit. Is there anything else I can do?

  • do what it says in the sticky thread, ie:- complain to s clark at the BPA
    no parking company has any policy on sending out recorded mail, nor do they have a policy on receiving recorded mail only as far as an appeal goes
    they issued an invoice by post , its deemed delivered 2 days later
    you appealed by post , its deemed delivered 2 days later
    neither of you was required to make this recorded and it wont say you have to send it recorded in their NTK either , if it did , you failed, they didnt require it so you didnt do it
    in future, get a free certificate of posting at the PO, that way the BPA have the proof they need when these things happen

    one aspect not answered in your query is this
    have you complained to the landowner and demanded a cancellation
    if not , why not ?
  • I didnt reply for you to copy and paste, just use it as a basis for your own letter , written by you , nor was that advice meant for him, although you can add it into your complaint if you wish to
    try google or ask the businesses on site , or pay the land registry for landowner details
    the only thread you should be reading is the NEWBIES sticky thread, cant see how reading other threads will help you here with your case
    all the info anybody needs is in that sticky thread
    you may be tired, but I am sure you could write your own letter of complaint regarding this to s clark
    bear in mind the BPA do not issue popla codes, nor will they look at your appeal, you are complaining that the PPC has breached their CoP

    Guess I was looking for other threads as there may have been other people in the same position as me who have already received advice on what to do.
  • there will be dozens of threads like yours , where the PPC has denied receiving the appeal, probably hundreds, (especially armtrac and apcoa and as parking , all who have taken it to an art form) which is why we tell people to get a free certificate of posting at the PO, so they can use this against the PPC when complaining to the BPA
    at the moment we only have your word for it, which is all the BPA will have too, your word, no proof

    ALL of the ppc`s can and do use this as a tactic to delay the prey species like yourself, plausible deniability I think its called ! they just allege they never received the appeal, in most cases those sending it dont bother to go to a PO and queue so they just stick a stamp on and post it as normal, like an xmas card , with no thought as to the consequences of not being able to prove it was sent later down the line
    the BPA may well decide that they have nothing to investigate because you cannot provide proof , same as judge rinder if this was in court , where he says "evidence, who ever thought you need evidence when bringing or defending a court case" - paper, he loves paper , a paper trail , proof , the same type of proof the BPA might ask for, or otherwise they may well dismiss your complaint as having no evidential proof
    once bit , twice shy , we are always wise after the event and next time you wont make this mistake again (I hope)
    dont think I am the oracle, I was new to all this less than 2 years ago, I have learned a lot since then , read a lot, realised the mistakes I could have made, the mistakes my relatives actually made when they appealed to the PPC for their invoices
    we have all been there, all been newbies , but my problem is I cannot wave a magic wand for you , I can only tell you to complain to the BPA and to the DVLA , plus to the landowner too, to rattle their cages like you see dom littlewood do on his tv programme
    the reason is , if you dont ask , you dont get, but just because you ask doesnt mean you will get , you may not get ! but you have to try to get !!!
    I hope your complaint results in a cancellation or a popla code from this PPC, but all it may get is a fudged fob off , mainly due to not having a proof of posting
    the ppc may well have a proof of posting for the one you received = 15 - love , you need to get to deuce or win the set by being more clever than they are (not hard in this game)
    sorry to say this, but this reply is designed as a reality check
    let us know in this thread how you get on though, I hope it goes in your favour , but my gut feeling tells me otherwise due to you not having done enough research in the beginning (so no proof of postage - a rookie mistake and one I learned more than 12 months ago on here having read many posts)
  • Stupid and lazy of me not to get the proof of postage, but as you say - it won't be a mistake I make again!
    In short if Mr Clark is unable to help - there is nothing I can do to contest the charge?
  • you need a popla code from the PPC to contest the charge
    otherwise, they have 6 years to take you to small claims court, at which point you have the right to contest the charge in front of the judge
    those are the 2 other methods of contesting the charge, notwithstanding the initial appeal to the ppc which also contested the charge
    so contesting the charge amounts to
    1) appealing to the ppc
    2) appealing to popla
    3) , ultimately, if it went to court, you contest it in court
    if 1) or 2) or 3) succeed , you have successfully contested the charge
  • UPDATE: Well, some good news.
    I complained via email to the BPA who in turn got in touch with the PPC and got them to look at my appeal (which they obviously rejected) - they moved the date of payment (Ј100) from 23rd Feb '15 to 3rd Mar '15. There was no mention of any POPLA number on the letter which was sent through, so I rang the PPC and asked for a number which they provided me with.
    I will now look through the sticky thread on how to appeal at POPLA.
  • add this denial of your rights, BPA complaint and lack of a paperwork popla code in your popla appeal, but make sure all the other main appeal points are used too
