A question about : NTK rules

Back in late 2013 got windscreen ticket
Never admitted I was driver and received NTK
Lost appeal with POPLA (did not do my research enough through this site)
After this gave them driver details as hoped process would start again and my partner would win case now we are better advised.
They are refusing to accept driver details and still wish to pursue keeper saying appeal was not received in time as per pcn (28 days)
Is my only option left court?

  Agreed the less posted the better hence did not divulge specific dates or company involved
  I gave the drivers details after losing an appeal to Popla (taking advice from this site) but at no time did I say I was the driver only the keeper of the vehicle.
  So what you are saying is that even though the 28 day period as considerably passed for notifying them who the driver was they can no longer pursue the keeper of the vehicle and must now pursue the named driver
