A question about : Didnt Know about CCJ, Issued to wrong address

Hi everyone,

I've recently had my LBM, and am in the process of setting up a DMP with CCCS.

I checked my credit report (which I've been too scared to so for a long time) and found I have a CCJ which was registered on 11/04/2011 to an address I lived at when I was a student (about 4 years ago).

This is for a payday loan debt I hoped had gone away.

Does anyone know if a CCJ is enforceable if it has been issued to an old address, as I had no knowledge of it and was unable to put together any defence? Or is there any process I can go through to appeal it or get it set aside?

  • If you haven't kept the creditor up to date with a current address, then they are allowed to send papers to the last address they had for you and obtain a CCJ.
    So unless you can prove that you told them of your current address, then sending the paperwork to the old one is not a good enough reason to get the CCJ set aside.
    If you have other very good reasons why you might have been able to defend had you known about it, then it still might be possible. But even then it could be difficult.
  • They are able to commence court proceedings to your last known address.
    If you could prove you had provided them with your new address and they'd still written to an old one you would very likely be able to get the judgement set aside (then they'd either apply for a new one or may agree to a repayment plan).
    It sounds like you didn't inform them of the address change - so a set aside claim would only likely be successful if there was another reason to do so - eg if you didn't owe the money claimed. Might be worth a read of https://www.nationaldebtline.co.uk/en...e_county_court
