A question about : Letter demanding payment from Lowell & Co.

Hi all, I have a problem that I'm hoping someone on here can help with.

This morning my MIL received a letter from Lowell & Co. chasing payment of an alleged outstanding credit card balance for a credit card my OH and I had several years ago with HBOS.

At the time we had the cc we were living in Scotland but emigrated to NZ in 2007. As far as we're aware we paid off all our debts before we left the UK. Any mail was redirected to our address in NZ for a period of about 6 months.

On 6.6.2010 my MIL received a similar letter chasing this same alleged outstanding balance. She spoke to them and gave them our email address, we heard nothing. I also wrote to them at the time demanding proof that we owed this money. We heard nothing from them.

I'm concerned that my MIL has now received a couple of phone calls from them stating that OH has to contact them urgently to arrange to pay this debt. I really don't want my MIL being hassled by them.

What should OH and I do?

  • If you are in New Zealand then you are outside the jurisdiction, I believe. Even if the debt isn't statute barred, it is to all intents and purposes completely uncollectable. All your MIL has to do is to bin all correspondence from them and wait for them to give up and disappear. They will. I know because I did that to them and they did. Stopped writing last year, never heard from them again.
    If she gets any letters from any other DCA, (debt may be sold on when Lowell give up) then tell her, don't reply, straight in bin.
    If anyone phones just tell them politely it's a wrong number. They shouldn't call again. They certainly didn't call me again and it was the right number, lol.
