A question about : my employer has done a runner!

Hiya,

My employer of 2.5 years has basically just upped and left the country leaving behind a string of debts. What can I do? I now have no job or redundancy pay for that matter! He is not officially bankrupt as yet but it wont be far off going by the letters we were receiving.

has anyone been through this scenario? Can you give me any pointers?

  • the state will pay up to 8 weeks statutory redundancy payment if your employer is made bankrupt. You can also claim holiday pay up to 6 weeks, unpaid pension contributions up to 6 weeks too.
    also perhaps the basic award for unfair dismissal... You have to claim through the employers rep. ( the liquidator)
    as you are not quite there on the bankruptcy, i would suggest speaking to your citizen advice bureau to see if your rights are the same prior to bankruptcy.
  • Is there any remnants of a business that could be salvaged by employees.
  • There could be quite a delay in getting your entitlements,if the director has done a bunk he will not be going into Voluntary Liquidation,he will have to wait for a creditor to go down the Winding up process which will involve the Official Receiver.
    This method could take two to three months
