A question about : Made redudant based on x hours per week
I was made redundant based on a 29.5 hour a week contract back at the end of September 2014 as my hours were reduced for medical reasons.
I have recently found a consultation form which states that it would rise if i work over a certain month (June), is it worth then contacting the HR dept to enquire about this as my redundancy was paid out at Ј5143 and I was working a 37.5 hour a week contract from March 2014.
Best answers:
- You are paid at the rate of hours you are working at the time of the redundancy.
You can ring ACAS to double check if you wish.
What form is it you have found and what is the exact wording. - What hours(contractual) were you working in the 12weeks before the termination date I guess July-Sept?
- My apologies, just in case.
Legislation changes far too often, I may well be wrong. - no probably right
just it is not clear from the post what hours they were doing and if a tranission was within the 12week averaging period there there is potential to use that.
Probably some case law to clarify this overlap period.
