A question about : Lowell portfolio

Hi, am new to all this so please be kind.......
I have just recieved a letter from Lowell Portfolio 1 Ltd saying that they have brought a debt from Capital One regarding 613 pounds. Now i do have a debt with, and poss with interest, do owe Capital One the money ( from about 4 to 5 years ago ).
My question is this.......
Is there any legal way of getting out of paying this?

  • Do you definatly owe the money?
    If you have any queries, you could contact Capital One as they should know about the original debt but you now owe Lowell £613
    They should be able to setup an installment plan for you, but apart from that I can't think of a way for you to get out of it
    EDIT: Maybe Debt Free Wannabe would be a better forum to ask in, those guys will have more experience with debt collectors and such /EDIT
  • I would suggest you contact Lowell QUICKLY as interest, I'm sure, will be increasing fast. You will be due the money and it is best to find out your options from Lowell.

  • I wouldnt be so quick to contact them, you sound unsure about how long ago this debt was from, and by sounds of it is very near to becoming statute barred. After 6 years of no contact made by yourself or payments, the debt becomes unenforcable. I'm not advocating not paying money you legitimately owe, but this could be the reason they have just made contact
    If the debt has been bought by a DCA then it is unlikely to be accruing additional interest
  • jamalfatty!! BUT if the debt is a suggest 4-5 years ago it has now been raised with the debtor and is surely having interest applied daily?

  • DCA's rarely add interest onto accounts so I would doubt very much that this account is increasing.
    If they have not been in contact for 4/5 years, and then a letter arrives out of blue, this would suggest account is almost statute barred and they are worried they will not get anything - happens with most debts as they near 6 years, you'll find yourself deluged with requests to make payment
  • I have also recived one for Ј15.31 to 3G . I not had a account with them for the last 21/2 years and all payments were made prior to porting my number so I will be a bit warry of this outfit
  • I have a default listed on my credit report with these guys.
    It's for Ј868 from 2003 on a card I apparently took out in 1999
    They claim it is from a Capital One credit card... However I do have a Capital One card... I have had the acount since 1998 & I still have that card account!
    I still use it!
    My next bill is due on the 28/jan/2009
    I rang Capital One who have no record of the account & pointed out that they would only issue one card per customer at any one time & would not issue a card to someone with an active default with them.
    They sugested I contact Lowell.
    Judging by posts left on these threads that would be a bad idea..
    What should I do???
  • My fiancee received a letter from this company in april requesting full payment for a debt of Ј762.63. It was for a currys account taken out about 5 years ago which we finished paying off in 2008.
    They are scammers dont talk to them over the phone as they will try to get your personal details! Demand everything in writing! And dont agree that you may owe the debt as even if you dont they have proof to take you to court!
    Basically just be very careful with the way you handle this company.

  • Hi i received a letter today from Buchananclark+wells whitch Lowell Portfolio l ltd have instructed them to collect Ј545.55. The letter is in my maided name whitch has been changed for 12yrs now. Some 1 has taken a vanquis credit card out in my maiden name in 2008. I have phoned buchananaclark up & now have to wait for paper work to arrive so i can check the details & take to the police station to prove its not me

    I had a bad debt with capital one which lowell portfolio had bought.
    i suggest you do your homework and find out exactly when the debt went bad and how much for. give lowell a call, i found they were really easy to deal with they will help you set up a payment plan (don't let them bully you into paying more than you can afford though. if they refuse a reasonable payment plan offer they are in the wrong by law)
    sorry but no way out of paying off bad debts.
    you could wait until its unenforceable but it will remain as a bad debt on your record for a further 7 years, if its paid off the record will be closed.

  • I have had dealings with Lowell Portfolio, Red debt, Hamptons Legal, Lowell Financial - they are all linked. They purchase old debts off of companies - companies that no longer feel it's beneficial to chase. However, i did an Experian free credit report and thats when it all started for me! they started writing to me from Red, misspelt my name, gave me a married title, they quoted an old address of mine and were demanding payment for an old 3G mobile. Now I had had one, 6 years ago. I lived at this address 4 years ago. See the problem!!?? I called them to be polite and discuss they were mis informed...well! big mistake. Only contact them in writing. Never disclose if they have any details wrong and they will correct this is later letters, do not admit to the debt, do not even say you have ever had a debt! get one of the print outs on this site they offer and basically say - I do not omit any debt to your company or the company you represent, i do not believe this debt is mine. I will have no further contact with you unless you show me evidence of debt i.e signature. They tried to say to me that I never signed for my mobile... which was on contract. Basically to cut long story short, they kept bombarding me with threatening letters, taking me to court, bailiffs will be coming round, if I pay now they will reduce debt by 50% etc they will try everything to make you panic. They will rail road you on the phone and bully you. Hang up and say I WILL NOT SPEAK TO YOU UNLESS IT IS IN WRITING. It took me 9 months, 27 letters, 9 phone calls until they responded by saying;
    "After investigating your concerns I can confirm that an automated trace procedure was undertaken in order to locate the current address of our customer. In this instance we used the services of a registered Credit Referencing Agency whose details incorrectly lead us to believe that our customer is residing at the above address blah blah blah we have arranged for your address to be removed blah blah. "
    They never answered why my name was wrong, why they never had a contract, why they were taking about a phone I had 4 years ago at an address I lived 6-7 years a go and didnt even have a bloody phone!
    Last week I got a letter from Buchanan Clark and Wells (not linked but same type of company) chasing me for an old loan. Again my name is spelt completely wrong! the loan I had with said company was paid off. I have not even bothered to write to them yet..... i was about to download letter omitting any debt and saw all other people going through the same. I only hope I haven’t bored you and what I say helps.
    NEVER CALL THEM - ALWAYS WRITE.
    KEEP LETTERS.
    NEVER PUT YOUR SIGNATURE OR CORRECT ANY MISPELLINGS ON YOUR NAME.
    NEVER OMIT TO ANY DEBT.
    THE DEBT IS NOT YOURS UNLESS THEY CAN PROVIDE PROOF!
    NEVER GET A FREE CREDIT REPORT!
    fight fight fight! think of all these poor old people or people that are not that savvy that presume and pay. They are bullies and must be stopped

  • nope dealt with them myself in the past they were great, they did have to refund in the end once the lender worked their mistake out
