A question about : looking for some advice (again)

Hi everyone,

I have two debts with Lowell (one for under Ј200, one for just over Ј700), which I am paying a small ammount towards a month. Lowell recently emailed and said they wanted to review my payment plan, to make sure I was still paying what I could afford. Fair enough, but I cannot afford to pay more at the moment so I am worried that they will start putting pressure on me, or even go for a ccj, irrational i know, but they scare me! Anyway, I have managed to ge around 40% of the full outstanding ammonts together and am ready to send them full and final offers, both the debts are around 4 years old. I plan on starting off by offering 25% not to be cheeky but just because I need them to accept 40% as its all I can give them, so i figure it's best to start too low and negotiate up. Is this my best course of action, does anyone think?
Also I drafted a letter using the debtline template, but included both the debts, being very clear about reference numbers and ammounts relating to each, is this ok, or should i send two seperate letters?

Any advice much appreciated as ever...

  • 25% is a good starter.
    I think one letter should be fine.
    They will ask where the money is coming from, best to say a family member and if possible get them to pay it if accepted.
    If your review shows you can't pay more, they wouldn't gain much by going to court.
    If they put pressure on you, send them a written complaint about trying to make you pay more than what you can afford.
  • I've said a friend is helping me! its not all coming from one place and the payment will have to come from me! I.hope that is not a sticking point. I haven't done the review yet going to send off the f+f tomorrow and sit and hope I get a positive response..! Thank you for your help happy bunny :-)
  • As the amounts you owe are fairly small, there is practically no chance they will ever go to court, so don't worry over that, good luck with the F & F `s !!!

    Offer is away.. So here's hoping! If they accept there is only one debt left on my credit file to sort out, and a couple of wee bits elsewhere. Then life can begin again!

  • So Lowell are not interested. They say the most they can offer is a ten percent discount, and my current payment plan is 'great'.
    Oh well. :-( (

    It's probably the several k ones that get them interested as a quick win.

    Can I ask yet another question, and pick everyones brain's again?!
    I have a debt with British gas, which only shows up on my noddle file, for just under Ј1000, from 2010. I have been trying to pay off this account but keep getting passed from pillar to post, British Gas have given me the names of two different dca's in two seperate emails over the last few months, who both say they had the account and have passed it back to British Gas. But when I phoned British Gas today (again) they told me they had absolutey no record of the account or of me ever being a customer?
    What do I do, just let sleeping dogs lie? or continue trying to find it? I dont want it to be sitting with some dodger DC company who have an old address, and end up with a ccj. And I want to pay it!!
    Any Ideas?

  • Yes happy_bunny British Gas report the debt on my file.

  • If you don't get a response within 14 days, follow up in writing.
    BG can be a bit selective in responding to complaints in my experience.
  • They got back to me today, found the debt on their system, and gave me the name of a dca (pdcs) who I have emailed asking to set up a payment plan. I have another wee debt with this company so should be simple enough. Just want to be done with all this debt malarkay now... Always think I'm nearly there then I realise I'm not!! Not to worry I will get there. Thank goodness for all the dfw's!
