A question about : The Liverpool Allen case result:

Hi All,

Many of you are aware of the Allen case in Liverpool due to be heard on the 25th Feb 2015.

Although not as momentous as the Huzar or Dawson case, it certainly has caught the UK's interest and was highlighted in Radio4s Money Box programme https://downloads.bbc.co.uk/podcasts/...0221-1234b.mp3

A few of the regular helpers on here are planning to attend as Coby Benson openly posted that it would be a 'public' execution .....errmmm, sorry 'pubic hearing'...

I know Tyzap has already posted that he will endeavour to keep the Jet2 thread updated with the result, I myself will try and keep the good Dr Watson's surgery updated with the results. It is not possible that we can all post in every specific airline thread with the result, just to be clear the result may determine Court Case directions for five airlines, Jet2, Ryanair, Wizz air, Flybe and Thomas Cook . So could I ask once this thread has been updated with the result, members copy the result to each of the specific airline threads?

I don't want this thread to be a discussion about the Allen case or the result, just simply to announce the result. It may well be that different airlines will continue to battle and sight another case in the Outer Hebrides, we shall see, so each airline may deal with the result differently so please keep to the specific airline thread to comment further...

  • Am I the only one who expects this "25th Feb - Allen Case" as nothing but a waste of time.
    It will change nothing.
    They will lose, they will ask to appeal (They will be denied / allowed)
    They will then go to the next rung up the ladder... They will lose again.
    All the way up to the Supreme Court... They will lose again.
    They will then scour the whole of the EU legal system for a similar case with the most tenuous of link to the bulk of their cases...
    They will then ask for "stays" to be imposed on their cases once again.
    And back to the beginning.
    ....
    I cannot understand why ONE Judge doesn't grow a set of b*lls and finally say to one airline in one case "I have deemed that this passenger IS entitled to flight delay compensation (In fact, you'll pay this dude triple compensation for having the tenacity to stay with it all this time in light of your obvious delaying tactics)... you as the airline MUST HUNT DOWN ALL PASSENGERS ON THIS FLIGHT AND I ORDER YOU TO COMPENSATE EVERYONE ON THAT FLIGHT"
    You just watch this "Airlines using the court process as a stalling tactic" thing clear right up.
  • Jet2fan - agree however it is the CAA who should be adopting this procedure however as long as they are funded by the airlines what chance they will start fining the airlines for non compliance with 261/2004?
    For this very same reason I cannot believe the suggested ombudsman scheme stands any more chance than Jet2 actually buying a NEW plane.
  • Is it not strange that KLM are not staying any awards /cases pending the Van Der Lans decision considering it involves them!!
    I'm sure they have had requests for compensation since that case started in Holland!
  • I've made it to Liverpool and they let me in, the Court is about a 3 minute walk away, so if I get up 3 mins to 10 I'm sure it will be fine....
    The only problem is parking, it's free until 7:30am then I've got to put a ticket on it, but I've even sorted that out by registering my phone, so I can pay from my hotel bed at 7:30 then fall back to sleep, Ohh what a life, it's a bit cold in Liverpool this evening, but there's a Yates over the road, so I'll be fine .......
    I've heard that there is a lot of media interest in this case, so I'm hoping that there's room in the courtroom for all, we'll see fingers crossed for the result........

  • I believe the One Show are doing a follow up to the Huzar v Jet2 saga and may be at the court tomorrow.
    Could be an interesting watch, whenever it's shown.
    Wonder if the court will allow live updates from the court a-la SC.
