A question about : Late payments into pension

My employer has recently started a new auto-enrollment pension scheme. Employee contributions have been deducted from my salary in the last 3 months but so far only the contribution from my August salary has reached my pension account on 1st October (over a month after it was deducted from my salary). At the moment my pension fund is doing really well (up over 4% in the last month) so I am missing out on this growth with the late arrival of my contributions into my pension. Is there anything I can do about this?

  • For a new scheme it's probably best to wait three more months because it could just be setup glitches that are being sorted out.
    The Pensions Regulator advises employers that "If you are deducting contributions from your worker's pay you must pay these to your scheme no later than the 22nd day (19th day for cheque payment) of the month following the month in which you deducted them" and that this is provided for by law, not merely code of practice.
    There is a voluntary code of practice for pension schemes that suggests that they should not report an employee to the regulator where the contributions are no more than 90 days late, unless there is some reason to believe that they won't be paid or are being diverted to other uses, like easing cash flow problems at the employer. If the pension provider reports to the regulator they should also report to all scheme members within 30 days of the report.
    If you want to act sooner then you may wish to informally ask your payroll handler whether there's a glitch causing a delay beyond the usual 22nd of the month deadline, without being unduly hard on them for a new scheme.
    If the amounts are non-trivial then you could ask them to pay you redress equal to the value difference between payment on the latest permitted day and the actual day of payment. Be sure you check the difference yourself before making this request so you don't accidentally ask them to pay redress that works out at less than say a Pound.
